halb,  wenn  die  Legitimation  zu  deren  Führung  und  damit  der
Charakter  als  Kriegsschiff  von  autoritativer  Seite  in  Frage  gestellt
  wird,  eines  anderweitigen  Nachweises;  dieser  wird  geführt
durch  die  ordnungsmässig  ausgefertigte  Segelordre,  enthaltend  den
dem  Befehlshaber  ertheilten  Auftrag).

4.  Die  Zugehörigkeit  eines  Schiffes  zur  Kriegsflotte  kann
eine  dauernde  oder  eine  vorübergehende  sein.  Eine  dauernde
Zugehörigkeit  liegt  vor,  wenn  das  betreffende  Schiff  entweder  von
vorne  herein  für  die  Kriegsmarine  erbaut  war,  oder  wenn  es  durch
Kauf,  Expropriation  für  Kriegszwecke,  oder  auf  Grund  eines
anderen  Erwerbstitels  eigenthümlich  auf  dieselbe  übergangen  ist.
Eine  vorübergehende  Zugehörigkeit  liegt  namentlich  dann  vor,
wenn  ein  Privatschiff,  sei  es  durch  Ermiethung  (Üharter),  sei  es
in  Folge  zwangsweiser  Inanspruchnahme  in  das  ausschliessliche
Nutzungsrecht  der  Kriegsmarine  auf  bestimmte  oder  auf  unbestimmte
