PARTIE  VII.
SANCTIONS.

Article  227.

Les  Puissances  alliées  ot  associées  mettent  en
accusation  publique  Guillaume  II  de  Hohenzollern,
  ex-empereur  d#Allemagne,  pour  offense
eupresme  contre  la  morale  internationale  et
Tautorité  sacrée  des  traités.

Un  Tribunal  spécial  sera  constitué  pour  juger
Taccusé  en  lui  assurant  les  garanties  essentielles.
du  droit  de  défense.  II  sera  composé  de  cindq  juges,
nommés  par  chacune  des  cing  Puissances
suivantes,  savoir:  les  Etats-Unis  d’Amérique,  la
Grande-Bretagne,  la  France,  IItalie  et  le  Japon.

Le  Tribunal  jugera  sur  motifs  inspirés  des
Principes  los  plus  élevés  de  la  politique  entre  les
nations  avec  le  souci  Tassurer  le  respect  des
obligations  solennelles  et  des  engagements  internationaux
  ainsi  due  de  la  morale  internationale.
I  lui  appartiendra  de  déterminer  la  peine  qu'il

estimera  devoir  stre  appliqucte.

Les  Puissances  alliées  et  associées  adresseront
au  Gouvernement  des  Pays-Bas  une  requste  le
priant  de  livrer  PTancien  empereur  entre  leurs
mains  pour  qu’il  soit  jugé.

Arkiele  226.

Le  Gouvernement  allemand  reconnaft  auxr
Puissances  alliéces  et  associéces  la  liberté  de
traduire  devant  leurs  tribunaux  militaires  les
personnes  accusées  Tavoir  commis  des  actes
contraires  aux  lois  et  coutumes  de  la  guerre.  Les
peines  prévucs  par  les  lois  seront  appliquées  aux
personnes  reconnues  coupables.  Cette  disposition
sappliguera  nonobstant  toutes  procédures  ou
poursuites  devant  une  iuridiction  de  IAllemagnoe
ou  de  ses  alliés.

PART  VII.
PENALITIES.

Artiele  227.

The  Allied  and  Associated  Powers  publiely
arraign  William  II  of  Hohenzollern,  formerly
German  Emperor,  for  a  supreme  offence  against
international  morality  and  the  sanctity  ol
treaties.

A  special  tribunal  will  be  constituted  to  try
the  accused,  thereby  assuring  him  the  guarantees
essential  to  the  right  of  defence.  It  will  bo
composed  of  five  judges,  one  appointed  by  each
of  the  following  Powers:  namely,  the  United-States
  of  America,  Groat  Britain,  France,  Italy,
and  Japan.

In  its  decision  the  tribunal  will  be  guided  by
the  highest  motives  of  international  policy,  with
a  view  to  vindicating  the  solemn  obligations  of
international  undertakings  and  the  validity  of
international  morality.  It  will  be  its  duty  to  fir
the  punishment  which  it  considers  should  be
imposed.

The  Allied  and  Asscciated  Powers  will  oddress
  a  request  to  the  Government  of  the  Netherlands
  for  the  surrender  to  them  of  the  ex-Emperor
in  order  that  he  may  be  put  on  trial.

Article  228.

The  German  Government  recognises  the  right
of  the  Allied  and  Associated  Powers  to  bring
before  military  tribunals  persons  accused  ol
having  committed  acts  in  violation'  of  the  lans
and  customs  of  war.  Such  persons  shall,  if
found  guilty,  be  sentenced  to  punishments  laid
down  by  law.  This  provision  will  apply
notwithstanding  any  proceedings  or  prosecution
before  a  tribunal  in  Germany  or  in  the  territory
of  her  allies.
