La  Commission  devra,  dans  les  délais  qu’elle
fixera  de  temps  à  autre,  et  si  le  Gouvernement
allemand  en  fait  la  demande,  entendre  tous  arguments
  et  teémoignages  présentés  par  P’Allemagno
sur  toutes  questions  se  rattachant  à  sa  capacité
de  payement.

8  10.

La  Commission  étudiera  les  réclamations  et
donnera  au  Gouvernement  allemand  T’équitable
laculté  de  se  faire  entendre,  sans  qu’il  puisse
prendre  aucune  part,  qduelle  qu’elle  soit,  aux
décisions  de  la  Commission.  La  Commission
donnera  la  meme  faculté  aux  alliés  de  l'Allemagno,
lorsqu'’elle  jugera  due  leurs  intérsts  sont  en  jeu.

§5  11.

La  Commission  ne  sera  liée  par  aucune  16gislation
  ni  par  aucun  code  particuliors,  ni  par
aucune  règle  spéecialo  concernant  D’instruction  ou
la  procéduro;  elle  sera  guidée  par  la  juetice,
Féquité  et  la  bonne  foi.  Ses  décisions  devront  se
conformer  à  des  principes  et  à  des  rèegles  uni-Hlormes
  dans  tous  les  cas  ou  ces  principes  et  ces
règles  seront  applicables.  Elle  fixera  les  regles
relatives  aux  modes  de  preuve  des  réclamations.
Elle  pourra  employer  toute  méthode  Iégitime  de
calcul.

§5  12.

La  Commission  aura  tous  les  pouvoirs  et
cxercera  toutes  les  attributions  à  elle  conférés
par  le  présent  Traité.  ·

la  Commission  est  constituée  par  Pensemble  des
Gouvernements  alliés  et  associés  visés  aux  para-1004

The  Commission  shall  be  roquired,  if  tho
German  Government  so  desire,  to  hear,  within  à
perioch  which  it  will  f  from  timo  to  time,
evidence  and  arguments  on  the  part  of  Germany
on  any  qduestion  connected  with  her  capacity
to  pay.

10.

The  Commission  shall  consider  the  claims
and  give  to  the  German  Government  a  just
Opportunity  to  be  heard,  but  not  to  take  auy
part  whatever  in  the  decisions  of  the  Commission.
  The  Commission  shall  afford  a  siwmilar
  opportunity  to  the  allies  of  Germany,  when
it  shall  consider  that  their  interests  are  in
duestion.

11.

The  Commission  shall  not  be  bound  by  any
Particular  code  or  rules  of  law  or  by  any  particular
  rule  of  evidence  or  of  procedure,  but  sball
be  guided  by  justice,  equity  and  good  faith.  Iis
decisions  must  follow  the  same  principles  ard
rules  in  all  cases  where  they  are  applicable.  It
will  establish  rules  relating  to  mothods  of  prook
of  claims.  It  may  act  on  any  trustworthy  modes
of  computation.

12.

The  Commission  shall  have  all  the  powen
conferred  upon  it,  and  shall  exercise  all  tbe
functions  assigned  to  it,  by  the  present  Treaty.

The  Commission  shall  in  gencral  have  wide  lati.
tude  as  to  its  control  and  handling  of  the  whole  reparation
  problem  as  dealt  with  in  this  part  ol  tho
present  Treaty  and  shall  have  authority  to  interpret
  its  provisions.  Subject  to  the  provisions  of  tbe
Present  Treaty,  the  Commission  is  constituted  br
the  several  Allied  and  Asscciatod  Governments  referred
  to  in  paragraphs  2  and  3  above  as  tho  cuck-
