  ne  soit  pas  désorganiséce  au  point  de  com-Dromettre
  sa  capacité  d’accomplir  les  autres  actes
de  réparation  exigés  Telle.

Toutefois,  il  ne  sera  demandé  à  1°’Allemagne
des  machines,  des  Cquipements,  des  tours  et  tous
articles  similaires  T’un  caractère  commercial  actuellement

  en  service  dans  P’industrie,  que  si  aucun
stock  de  ces  articles  n’est  disponible  et  à  vendre;

Fautre  part,  les  demandes  de  cette  nature  M'excéderont
  pas  30  p.  100  des  quantités  de  chaque  artiche
  en  service  dans  un  "tablissement  allemand
ou  une  entreprise  allemande  quelconque.

La  Commission  donnera  aux  représentants  du
Gouvernement  allemand  la  faculté  de  se  faire
entendre,  dans  un  délai  déterminé,  sur  sa  capacité
de  fournir  lesdits  matériaux,  animaux  et  objets.

La  décision  de  la  Commission  sera  ensuite,  et
le  plus  rapidement  possible,  notisié  au  Gouver--noment
  allemand  et  aux  différents  Gouvernements
alliés  et  associés  int  éressés.

Le  Gouvernement  allemand  s'’engage  à  livrer
les  matériaux,  objets  et  animaux,  préecisés  dans
cette  notification,  et  les  Gouvernements  alliés  et
associés  intéressés  s'engagent,  chacun  pour  ce  qui
le  concerne,  à  accepter  ces  memes  fournitures,
sous  réserve  du’elles  seront  conformes  aux  spécifcations
  données  ou  ne  seront  pas,  de  Pavie  de  la
Commission,  impropres  à  Temploi  requis  pour  le
travail  de  réparation.

85.

La  Commission  déterminera  la  valeur  à  attribuer
  aux  matériaux,  objets  et  animauxz,  livrés
comme  il  est  dit  ci-dessus,  et  les  Gouvernements
alliés  et  associés  qui  recevront  ces  fournitures
eacceptent  d’'’etre  débites  de  leur  valeur  et  reconnaissent
  que  la  somme  correspondante  devra  ötre
traitee  comme  un  payement  fait  par  TPAllemagne,
à  réöpartir  conformément  à  F’article  237  de  la  présente
  Partio  du  présent  Traitá.

Allied  and  Asscciated  Governments  that  the  industrial
  life  of  Germany  be  not  ao  disorganised
as  to  affect  adversely  the  ability  of  Germany  to
Perform  the  other  acts  of  reparation  stipulated  for.

Machinery,  equipment,  tools  and  like  articles
  of  a  commercial  character  in  actual  industrial
  use  are  not,  however,  to  be  demanded  ot
Germany  unless  there  is  no  free  stock  of  such
articles  respectively  which  is  not  in  use  and  is
available,  and  then  not  in  excess  of  thirty  per
cent.  of  the  qduantity  of  such  articles  in  uss  in
any  one  establishment  or  undertaking.

The  Commission  shall  give  representatives  ef
the  German  Government  an  opportunity  and  a
time  to  be  heard  as  to  their  capacity  to  furnieh
tho  said  materials,  articles  and  animals.

The  decision  of  the  Commission  shall  thereupon
and  at  the  earliest  possible  moment  be  communicated
  to  the  German  Government  and  to  tho
several  interested  Allied  and  Associated  Covernments.

The  German  Government  undertakes  to  deliver
the  materials,  articles  and  animals  as  specified  in
the  said  communication,  and  the  interested  Allied
and  Associated  Governments  severally  agree  to

accept  the  same,  provided  they  conform  to  the

specification  given,  or  are  not,  in  the  judägment
  of  the  Commission,  unfit  to  be  utilized  im
the  work  of  reparation.

5.

The  Commission  shall  determine  the  value  to
be  attributed  to  the  materials,  articles  and  animals
  to  be  delivered  in  accordance  with  the  foregoing,
  and  the  Allied  or  Associated  Power  receiving
  the  Same  agrees  to  be  charged  with  such
value,  and  the  amount  thereof  shall  be  treated  as
a  payment  by7  Germany  to  be  divided  in  accordance
  with  Article  237  of  this  Part  of  the  present
Treaty.
