Article  253.

Ces  dispositions  ne  peuvent  afflecter,  en
aucund  manière,  les  gages  ou  hypothèques  régulièrement
  constitués  au  profit  des  Puissances
allices  ct  associèces  ou  de  leurs  ressortissants  par
Empire  ou  les  Etats  allemands  ou  par  des  ressortissants
  allemands  sur  les  biens  et  rovenus  leur
appartenant,  dans  tous  les  cas  on  la  constitution
do  cos  gages  ou  hypothèques  serait  antérieure  à
D’existence  de  I’état  de  guerre  entre  le  Gouvernemont
  allemand  et  chacun  des  Gouvernements  intéressés.


Article  254.

Les  Puissances  auxquelles  sont  cédés  des
territoires  allemands  devront,  sous  réserve  des
disposilions  de  I'Article  255,  assumer  le  payement.
  de  :

%  Une  part  de  la  Dette  do  I'’Empire  allemand,
telle  qu'elle  était  constituée  le  1½°’i  acüt  1914,  et
calculẽo  en  prenant  pour  base  la  moyenne  des  trois
années  financières  1911,  1912  et  1913,  d’après
les  rapport  existant  entre  telle  catégorie  de
revenus  dans  le  territoire  cédé  et  les  revenus  correspondants
  de  la  totalité  de  IEmpire  allemand
dui  seront  désignés  par  la  Commission  des  réparations
  commo  donnant  la  juste  mesure  des  facultés
  respectives  de  payement  dos  territoires
cédés;

2°  Une  part  de  la  Dette,  telle  qu’elle  existait
au  ler  aoũt  1914,  de  l'Etat  allemand  auduel  le
territoire  cédé  appartenait  et  calculée  d’après  le
principe  exposé  ci-dessus.

Ces  parts  seront  déterminées  par  la  Commission
  des  réparations.

Le  mode  d’exécution  de  Tobligation  ainsi
assumee,  à  la  fois  en  capital  et  en  intéréts,  sera
fixé  par  la  Commission  des  réparations.  II  pourra
affector,  entre  autres,  la  forme  suivante:  le  Gouvernement
  cessionnaire  assumere  les  obligations

Articke  253.

Jothing  in  the  foregoing  provisions  eball
prejudice  in  any  manner  charges  or  mortgagos
lawfully  effected  in  favour  of  the  Allicd  or  Associated
  Powers  or  their  nationals  respectively,
before  the  date  at  which  a  state  of  war  eristed
between  Germany  and  the  Allied  or  Associated
Power  concerned,  by  the  German  Empire  or  its
constituent  States,  or  by  German  nationals,  on
assets  in  their  ownership  at  that  date.

Arkticke  254.

The  Powers  to  which  German  territory  is
ceded  shall,  subject  to  the  qualifications  made  in
Article  255,  undertake  to  pay:  «

(1)  A  portion  of  the  debt  of  the  German
Empire  as  it  stood  on  August  1,.
1914,  calculated  on  the  basis  of  the  ratio
between  the  average  for  the  tbree  financial
  years  1911,  1912,  1913,  of  such
revenues  of  the  ceded  territory,  and  tho
average  for  the  same  Fears  of  such  revenues
  of  the  whole  German  Empire  as  in
the  judgment  of  the  Reparation  Commission
  are  best  calculated  to  represent
the  relative  ability  of  the  resvpective
territories  to  make  payment;

A  portion  of  the  debt  as  it  stood  on
August  1,  1914,  of  the  German
State  to  which  the  ceded  territory
belonged,  to  be  determined  in  accordance
with  the  principle  stated  above.

Such  portions  shall  be  determined  by  tlo
Reparation  Commission.

The  method  of  discharging  the  obligation,
both  in  respect  of  capital  and  of  interest,  so
assumed  shall  be  fred  by  the  Reparation  Commission.
  Such  mothod  may  take  the  form,  inter
alia,  of  the  assumption  by  the  Powor  to  which
