Section  VI.  IIs  pourront  stro  grevé:,  en  second
lieu,  du  payement  des  indemnités  dues  à  PToccasion
des  réclamations  des  ressortissants  de  la  Puissance
  allice  ou  associée  concernant  leurs  biens,
droits  et  intérsts  sur  le  territoire  des  autres  Puis--sances
  ennemies,  en  tant  que  ces  indemnités  n'ont
pas  été6  acquittées  d’une  autre  manire.

55.

Nonobstant  les  dispositions  de  Partiche  297.

lorsque,  immédiatement  avant  le  début  de  la
guerre,  une  société  autorisée  dans  un  Etat  allié
ou  associé  avait,  en  commun  avec  une  société  contrölte
  par  elle  et  autorisée  en  Allemagne,  des
droits  à  Tutilisation  dans  Tautres  pays,  de  mardues
  de  fabrique  ou  commerciales,  ou  lorsqu’elle
avait  la  jouissance  avec  cette  société  de  procédés
exclusifs  de  fabrication  de  marchandises  ou  d’artichles
  pour  la  vente  dans  d’'autre  pays,  la  premidre
  société  aura  geule  le  droit  d'utiliser  ces
marques  de  fabrique  dans  d’autres  pays,  à  Peuxclusion
  de  la  société  allemande;  et  les  procédés  de
fabrication  communs  seront  remis  à  la  premire
société  nonobstant  toute  mesure  prise  en  application
  de  la  1égislation  de  guerre  allemande  à
Téegard  de  la  seconde  société  ou  de  ses  intérsts,
propriétés  commerciales  ou  actions.  Néammoins,
la  première  société,  si  demande  lui  en  est  faite,
remettra  à  la  seconde  société  des  modeèles  permettant
  de  continuer  la  fabrication  de  marchandises
dui  derront  stre  consommées  en  Allemagne.

86.

Jusqu’au  moment  on  la  restitution  pourra
etre  effectuf  conformément  à  T’article  297,  LAllemagne
  est  responsable  de  la  conservation  des
biens,  droits  et  intéröts  des  ressortissants  des
Puissances  alliées  ou  associées  7  compris  les  société
  et  associations  dans  lesquelles  ces  ressortissants
  étaient  intéressés,  qui  ont  été  soumis  par
alle  à  une  mesure  exceptionnelle  de  guerre.

They  may  be  charged  in  the  second  place  with
payment  of  the  amounts  due  in  respect  of  claims
by  the  nationals  of  such  Allied  or  Asscciated
Power  with  regard  to  their  property,  rights  and
tnterests  in  tbe  territory  of  other  enemy  Powere,
in  so  far  as  those  claims  are  otherwise  unsatisfied.

Notwithstanding  the  provisions  of  Article  297,
where  immediately  before  the  outbreak  of  war  à
company  incorporated  in  an  Allied  or  Associated
State  had  rights  in  common  with  a  company
controlled  by  it  and  incorporated  in  Germany  to
the  use  ef  trade-marks  in  third  countries,  or  enjoyed
  the  use  in  common  with  such  company  of
unique  means  of  reproduction  of  goods  or  articles
for  sale  in  third  countries,  the  former  company
ahall  alone  have  the  right  to  use  these  trademarks
  in  third  countries  to  the  exclusion  of  the
German  company,  and  these  unique  means  of  ro-Production
  ehall  be  handed  over  to  the  former
company,  notwithstanding  any  action  taken  under
German  war  legislation  with  regärd  to  the  latter
company  or  its  business,  industrial  property  or
shares.  Nevertheless,  the  former  company,  if  requested,
  ahall  deliver  to  the  latter  company  derivative
  copies  permitting  the  continuation  of  reproduction
  of  articles  for  use  within  German
territory.

Up  to  tbe  time  when  restitution  is  carried
out  in  accordance  with  Article  297,  Germany  is
responeible  for  the  conservation  of  property,
rights  and  interests  of  the  nationals  of  Allied  or
Associated  Powers,  including  companies  and  associations
  in  which  they  are  interested,  tbat  havo
been  subjectech  by  her  to  erxceptional  war
measures.
