e)  Aueuno  disposilion  du  présent  article  ot
de  IAnnexe  ci-jointe  ne  peut  ötre  regardee  comme

invalidant  une  opération  qui  a  été  elfectuée  légalement

  en  vertu  DTun  contrat  passé  entre  onnemis
avec  T’autorisation  d'uns  des  Puissancos  belli-Grantes.


Arkicke  300.

a)  Sur  le  territoire  des  Hautes  Partie  Contractantes,
  dans  les  rapports  entre  ennemis,  tous
délais  quclconques  de  prescription,  péremption  ou
forclusion  de  Drocédure  seront  suspendus  pendant
la  durde  de  la  guorro,  qu’ils  aient  commencé  à

courir  avant  le  début  de  la  guerro  ou  après;  ils

recommenceront  à  courir  au  plus  töt  trois  mois
nprès  la  mise  en  vigucur  du  présent  Traité.  Cette
disposition  s'’appliquera  aux  délais  de  présentation
de  coupons  Tintérts  ou  de  dividendes,  et  de
Drésentation,  en  vue  du  remboursement,  des
valeurs  sorties  uu  tirage  ou  remboursables  à  tout
autre  titre.

5)  Dans  le  cas  on,  en  raison  du  non-accomplissement
  d'un  acte  ou  d’une  formalité  pendant  la
guerre,  des  mesures  d’exécution  ont  6té  prises  sur
le  territoiro  allemand  portant  préjudice  à  un  ressortissant
  des  Puissances  alliées  ou  associces,  la
réclamation  formulée  par  le  ressortissant  d'uno
Puissance  alliée  ou  associée  sera  portée  devant
le  Tribunal  arbitral  mixte  prévu  par  la  Scction
  VI,  à  moins  due  T’affaire  ne  soit  de  la  competence
  d’un  Tribunal  d’'une  Puissance  alliée  ou
associée.

c)  Sur  la  demande  du  ressortissant  intéressé
d’une  Puissance  alliée  ou  associée,  lo  Tribunal
arbitral  mixte  prononcera  la  restauration  des
droits  Iésés  par  les  mesures  d’exécution  mentionnées
  au  paragraphe  5),  toutes  les  fois  qu’en  raison
des  circonstances  spéciales  de  D’affaire  cela  sera
CGquitable  et  possible.

Dans  le  cas  on  coette  restauration  serait  injuste
  ou  impossible,  le  Tribunal  arbitral  mixte

(e)  Nothing  in  the  prosent  Artielo  or  sho
annex  hereto  shall  be  deemed  to  invalidato  a
transaction  lawfully  carried  out  in  accordance
with  a  contract  between  enemies  if  it  has  been
carried  out  with  the  authority  ol  onco  of-  the.
belligerent  Powers.

Articke  300.
(Cc)  All  periods  of  proscription,  or  limitation
of  right  of.  action,  whether  they  began  to  run
before  or  after  the  outbreak  of  war,  shall  be

treated  in  the  territory  of-the  High  Contracting

Parties,  so  far  as  regards  relalions  betweon
enemies,  as  having  been  suspended  for  the
duration  of  the  war.  They  shall  begin  to  run
again  at  earliest  three  months  alter  the  coming
into  force  of  the  present  Treaty.  This  provision
shall  apply  to  the  period  prcscribed  for  the
presentation  of  interest  or  dividend  coupons  or
for  the  presentation  for  repayment  of  securities
drawn  for  repayment  or  repayable  on  any  other
ground.  ·
(5)  Where,  on  account  of  failure  to  perform
any  act  or  comply  with  any  formality  during  the

.  War,  measures  of  edecution  have  been  takon  in

German  territory  to  the  prejudico  of  a  national
of  an  Allied  or  Associated  Power,  the  claim  of
such  national  shall,  if  the  matter  does  not  fall
within  the  competence  of  the  Courts  of  an  Allied
or  Associated  Power,  be  heard  by  the  Alixed

Arbitral  Tribunal  provided  for  by  Section  VI.

(c)  Upon  the  application  of  any  interested
person  who  is  a  national  of  an  Allied  or
Associated  Power  the  Mixed  Arbitral  Tribunal
shall  ·  order  the  restoration  of  the  rights  which
have  been  preiudiced  by  the  measures  of  oxeeution
referred  to  in  paragraph  (5),  wherever,  bavins
regard  to  the  particular  circumstances  of  the
case,  such  restoration  is  equitable  and  possible.

If  such  restoration  is  inequitable  or  impossible
the  Mixed  Arbitral  Tribunal  may  grant  compen-
