)  Lorsqu'’un  contrat  entre  ennemis  a  6té
involidé,  soit  en  raison  du  fait  qufune  des  parties
n'en  a  pas  exécuté  une  clause,  soit  en  raison  de
Toxercice  d’un  droit  stipulé  au  contrat,  la  partie
Jéséo  pourra  s'adresser  au  Tribunal  arbitral  mixte
pour  obtenir  réparation.  Le  Tribunal  aura,  dans
ce  Cas,  los  pouvoirs  prévus  au  paragraphe  c).

e)  Les  dispositions  des  paragraphes  précédents
  du  présent  article  s'appliqueront  aux  ressortissants
  des  Puissances  Alliéces  ou  Asscciées
qui  ont  subi  un  préjudico  en  raison  de  mesures  cidessus
  prévues,  prises  par  IAllemagne  en  territoire
  envabi  ou  cccupé,  s'ils  n’en  ont  été  indemnisés
  autrement.

)  L'’Allemagne  indemnisera  tout  tiers  lésé
par  les  restitutions  ou  restaurations  de  droit
prononcéces  Dar  le  Tribunal  arbitral  mixte  con-4ormment
  aux  dispositions  des  Daragraphes  précédents
  du  présent  article.

9)  En  ce  qui  concerne  les  effets  de  commerce,

Article  301.

German  Government.

(d)  Where  a  contract  between  encmics  has
been  dissolved  by  reason  either  of  failure  on  the
Dart  of  either  party  to  carry  out  its  prorisions
or  of  the  cexercise  of  a  right  stipulaled  in  tho
contract  itself  tho  party  prejudiced  may  apply  to
the  Mixed  Arbitral  Tribunal  for  relief.  The
Tribunal  will  have  the  powers  provided  for  in
Daragraph  (c).  '

(e)  Tho  provisions  of  tho  preceding  paragraphs
  of  this  Article  shall  apply  to  tbo
nationals  of  Allied  and  Associated  Powers  who
have  been  prejudiced  by  reason  of  measures
referred  to  above  taken  by  Germany  in  invaded
or  occupied  territory,  if  they  have  not  been  otherwise
  compensated.

(I!)  Germany  shall  compensate  any  third
party  who  may  be  prejudiced  by  any  restitulion

or  restoration  ordered  by  the  Mixed  Arbitral

Tribunal  undor  the  provisions  of  the  preceding
Paragraphs  of  this  Article.

()As  regards  negotiable  instruments,  the
period  of  three  months  provided  under  paragraph
  (a)  shall  commence  as  from  the  date  on
which  any  exceptional  regulations  applied  in  the
territories  of  the  interested  Power  with  regard
to  negotiable  instruments  shall  have  deofinitely
ceasod  to  have  force.

·  Article  301.

As  between  enemies  no  negotiable  instrument
made  before  the  war  shall  be  deemed  to  have
become  invalid  by  reason  only  of  failure  within
the  required  time  to  present  the  instrument  for
acceptance  or  payment  or  to  giye  notice  of  nonacceptanco
  or  non-payment  to  drawers  or
indorsers  or  to  protest  the  instrument,  nor  by
reason  of  failure  to  complete  any  formality
during  the  war.
