pendant  la  guerre,  et  si  la  partie  qui  aurait  ddprésenter

  ou  protester  Peffet  ou  donner  avis  de
la  non-acceptation  ou  du  non-payemont  ne  l'a  pas
fait  pendant  la  guerre,  il  lui  sera  accordé  au
moins  trois  mois  après  la  mise  en  vigueur  du
présent  Traité  pour  présenter  Teffet,  donner  avis
de  non-acceptation  ou  de  non-payement  ou  dresser
Protöt.  ·

Les  jugements  rendus  par  les  tribunaux  d'une
Puissunce  allice  ou  associée,  dans  le  cas  on  ces
(ribunaux  sont  compétents  d’après  le  présent
Traité,  seront  considérés  en  Allemagnoe  comme
ayant  Tautorité  de  la  chose  jugée  et  7  seront
exéeutés  sang  owil  soit  besoin  d’exequatur.

Si  un  jugement,  en  quelque  matière  qu'il  soit

intervenu,  a  éte  rendu,  pendant  la  guerre,  par  un

tribunal  allemand,  contre  un  rossortissant  des
Puissances  allices  ou  associées,  dans  une  instance
où  celui-ci  n'a  pas  pu  se  déefendre,  le  ressortissant
allié  ou  associé  qui  aura  subi,  de  ce  chef,  un
préjudice  pourra  obtenir  une  réparation  qui  sera
determinée  par  le  Tribunal  arbitral  mixte  prévu
par  la  Section  VV.

Sur  la  demande  du  ressortissant  de  la  Puissance
  alliée  ou  associée,  la  Féparation  ci-dessus
pourra  öatre,  sur  Pordre  du  Tribunal  arbitral
miste  et  lorsque  cela  sera  possible,  elfectuée  en
replaçant  les  parties  dans  la  situation  où  elles
se  trouvaient  avant  le  jugement  rendu  par  le  tribunal
  allemand.  ç

La  réparation  ci-dessus  pourra  õtre  é6galement
obtenue  devant  le  Tribunal  mixte,  par  les  ressortissants
  des  Puissances  alliéces  ou  associées  qui
ont  subi  un  préjudico  du  fait  des  mesures  judi-1156



Si  la  période  pendant  laquelle  un  effet  de  com-Where

  the  period  within  which  a  negotiablo
instrument  should  have  been  procscnted  for
accoptance  or  for  payment,  or  within  which  votico
of  non-acceptance  or  non-payment  should  have
been  given  to  the  drawer  or  indorser,  or  within
which  the  instrument  should  have  been  protested,
has  elapsed  during  the  war,  and  the  party  whoshould
  have  presented  or  protested  the  instrument
  or  have  given  notice  of  non-acceptance  or
non-payment  has  failed  to  do  so  during  the  war,
a  period  of  not  less  than  three  monthe  from  the
coming  into  force  of  the  present  Treaty  sball  be
allowed  within  which  presentation,  notice  of  nonacceptance
  or  non-payment  or  protest  may  be
made.

Article  302.

Judgments  given  by  the  Courts  of  an  Allied
or  Associated  Power  in  all  cases  which,  under
the  present  Treaty,  they  are  competent  to
decide,  shall  be  recognised  in  Germany  as  fßinal,
and  shall  be  enforced  witbout  it  being  necessary.
to  have  them  declared  executory.

If  a  judgment  in  respect  of  any  dispute  which
may  bave  arisen  has  been  given  during  the  war
by  a  German  Court  against  a  national  of  an
Allied  or  Associated  State  in  a  case  in  which  he
was  not  able  to  make  his  defence,  the  Allied  and
Associated  national  who  has  suffered  prejudics
thereb!y  shall  be  entitled  to  recover  compensation,
to  be  fred  by  tbe  Mixed  Arbitral  Tribunädl
provided  for  in  Section  VI.

At  the  instance  of  the  national  of  the
Allied  or  Associated  Power  the  compensation
above-mentioned  may,  upon  order  to  that  eflect
of  the  Mixed  Arbitral  Tribunal,  be  effected  where
it  is  possible  by  replacing  the  parties  in  tbe
situstion  which  they  odecupied  before  the
judgment  was  given  by  the  German  Court.

The  above  compensation  may  likewise  be
obtäined  before  the  Miked  Arbitral  Tribunal  by
the  nationals  of  Allied  or  Aescciated  Powers
Who  have  suffered  prejudice  by  indicial  measures
