LII.  Contrats  d’asst#ncss.

Les  contrats  d’assurances  conclus  entre  une
Personne  et  une  autre  devenue  par  la  suite  ennemie
soront  réglés  Cconformément  aux  articles  suivants.

Aæsurances  contre  Tincendie.
89.

Les  contrats  d'assuranee  contre  Tincendie,
concernant  des  propriétés,  passés  entre  une
pPersonne  ayant  des  intérsts  dans  cette  propriété
et  une  personne  devenue  par  la  suite  ennemie,
ne  seront  pas  considérés  comme  annulés  par
Touverture  des  hostilités  ou  par  le  fait  due  la
Lersonne  est  devenue  ennemie  ou  parce  qu'une  des
Parties  n’a  pas  accompli  une  clause  du  contrat
Pondant  la  guerre  ou  pendant  une  période  de  trois
mois  après  la  guerre,  mais  seront  annulés  à  partir
de  la  premieère  échéance  de  la  prime  annuelle
survenant  trois  mois  après  la  mise  en  vigueur  du
Présent  Traité.

Un  reèglement  sera  effectué  pour  les  primes
non  payées,  éEchues  pendant  la  guerre,  ou  pour  les
réclamations  pour  des  pertes  encourues  pendant
la  guerre.

Si,  par  suite  d’un  acte  administratifk  ou
J  #gislatif,  une  assurance  contre  Dincendie,  concluo
antérieurement  à  la  guerre,  a  été  pendant  la  guerre
transfé#rée  de  F’assureur  primitif  à  un  autre
sassureur,  le  transfert  sera  reconnu  ot  la
responsabilits  de  l’'assureur  primitif  sera
considérẽo  comme  ayant  cessé  à  partir  du  jour  du
transfert.  Cependant,  D’assureur  primitif  aura  le

in  accordunco  with  an  undertaking  given  to  him
by  a  person  who  has  subsequently  become  an
enemy,  tliee  latter  shall  remain  liable  to  indemnify

  the  former  in  rospect  of  his  liability

notwithstanding  the  outbreak  of  war.

III.  Contracts  of  Insurancs.

8.

Contracts  of  insurance  entered  into  by  any
Person  with  another  porson  who  gubsequently
became  an  enemy  will  be  dealt  with  in  accordance
  with  the  following  paragraphs.

Fire  Insurance.

Contracts  for  the  insurance  of  property
against  fire  entered  into  by  a  person  interested.
in  such  property  with  another  person  who
subsequently  became  an  enemy  shall  not  be
deemed  to  have  been  dissolved  by  the  outbreak
of  war,  or  by  the  fact  of  the  person  becoming  an
enemy,  or  on  account  of  the  failure  durins  ibe
war  and  for  a  period  of  three  months  thoereafter
to  perform  bis  obligations  under  the  contract,
but  they  shall  be  dissolved  at  the  date  when  tbe
annual  premium  becomes  payable  for  the  first
time  after  the  expiration  of  a  period  of  three
months  after  the  coming  into  force  of  the  present

Trcaty.

A  settlement  shall  be  effected  of  unpaid
premiums  which  became  duo  during  the  war,  or
of  claims  for  losses  which  occurrod  during  the  war.

.  10.

Whore  by  administrativõ  or  legislative  action
an  insuxance  against  fire  effected  before  the  war
has  been  transferred  during  the  war  from  the
original  to  another  insurer,  the  transfer  will  be
rocognised  and  the  liability  of  the  original  imsurer
will  be  deemed  ko  have  ceased  as  from  the  date  of
the  transfer.  The  original  insuror  will,  however,
be  entitled  to  receive  ön  demand  full  information
