Chaque  Puissance  alliée  ou  associée  aura,  dans
les  trois  mois  qui  suivront  la  mise  en  vigueur  du
Drésent  Traité,  la  faculté  de  résilier  tous  les
contrats  d'assuranee  en  cours  entre  une
Compagnie  d’Assurance  allemande  et  es
ressortissants  dans  des  condilions  soustrayant
lesdils  ressort  issants  à  tout  préjudice.

A  cette  fin,  la  Compagnie  d’Assurance  allemande
  transférera  au  Gouvernement  de  la
Puissance  allice  ou  associée  intéressée,  la
PFrobortion  de  son  actif  attribunble  aux  polices
ainsi  annulées  et  sera  délice  de  toute  obligation,
par  rapport  à  ces  polices.  L'actif  à  transférer  sera
sixé  par  un  actkuaire  désigné  par  le  Tribunal
arbitral  mixte.

Si  des  contrats  d’assurance  sur  la  vie  ont  614
conclus  par  une  succursale  d’'une  Compagnie
d'Assurances  stablie  dans  un  pays  devenu,  par  la
suite,  ennemie,  le  contrat  devra,  en  I’absence  de
(oute  stipulation  contraire  contenue  dans  le
contrat  lui-memc,  éire  régi  par  la  loi  locale,  mais
Tassureur  aura  le  droit  de  demander  à  I’assuré  ou
à  ses  représentants  le  remboursement  des  sommcs
pares  sur  des  demandes  faites  ou  imposées,  par
application  de  mesures  prises  pendant  la  guerre,
contrairement  aux  termes  du  contrat  lui-meme,
et  aux  lois  et  traités  existant  à  I’époque  on  il  a

Dans  tous  les  cas  où,  en  vertu  de  la  loi
applicable  au  contrat,  I’assureur  reste  lis  par  le
contrat  nonobstant  le  non-payement  des  primes,
jusqu'a  ce  que  Ton  ait  fait  part  à  F’assuré  de  la
décheance  du  contrat,  il  aura  le  droit  Ià  oü,  par
suite  de  la  gucrre,  il  n’aurait  pu  donner  cet
avcrtissement,  de  recouvrer  sur  T’assurs  les  primes
non  payces,  augmentées  des  intérsts  à  5  p.  100  P’an.

12.

Any  Allied  or  Associated  Power  may  within
three  months  of  the  coming  into  force  of  the
Present  Treaty  cancel  all  the  contracts  of  insurance
  running  between  a  German  insurance  com-Pany
  and  its  nationals  under  conditions  which
shall  protect  its  nationals  from  any  prejucico.

To  this  end  the  German  insuranco  company
will  hand  over  to  the  Allied  or  Associated  Government
  concerned  the  proportion  of  its  assets  attributable
  to  the  policies  so  cancelled  and  will  be
relieved  from  all  liability  in  respect  of  such
policies.  The  assels  to  be  handed  over  shall  bo
determined  by  an  actuary  appointed  by  tho
Mixed  Arbitral  Tribunal.

13.

Where  contracts  of  life  insurance  have  been
entered  into  by  a  local  branch  of  an  insurance
company  established  in  a  country  whieh  subseqduently
  became  an  enemy  country,  the  contract
shall,  in  the  absence  of  any  stipulation  to  the
contrary  in  the  contract  itself,  be  governed  by
the  local  law,  but  the  insurer  shall  be  entitled
to  demand  from  the  insured  or  his  representatives
  the  refund  of  sums  paid  on  claims  made  or
enforced  under  measures  taken  during  the  war,
if  the  making  or  enforcement  of  such  claims  was
not  in  accordance  with  the  terms  of  the  contract
itself  or  was  notf  consistent  with  the  laws  or
treaties  eristing  at  the  time  when  it  was
entered  into.

In  any  case  where  by  the  law  applicable  to
the  contract  the  insurer  remains  bound  by  tho
contract  notwithstanding  the  non-payment  ol
premiums  until  notice  is  given  to  the  insured  ol
the  termination  of  the  contract,  he  shall  bo
entitled  where  the  giving  of  such  nolice  was
prevented  by  the  war  to  recover  the  unpaid
premiums  with  intercst  at  fivo  por  cent.  per
annum  from  the  insured.
