b)  Les  Tribunaux  arbitraux  mixtes  eréés  par
application  du  paragraphe  a)  jugeront  les  différends
  qui  sont  de  leur  compétence,  aux  termes  des
Sectkions  III,  IV,  V  et  VII.

En  outre,  tous  les  différends,  duels  qu'ils
soient,  relatifs  aux  contrats  conclus,  avant  la
mise  en  vigueur  du  présent  Traité,  entre  les  ressortissants
  des  Puissances  alliées  et  associées  et
les  ressortissants  allemands,  seront  réglés  par  le
Tribunal  arbitral  mixte,  à  Texception  toutefois
des  dillérends  qui,  par  application  des  lois  des
Puissances  alliées,  associées  ou  neutres,  sont  de
la  compétence  des  tribunauft  nationaut  de  ces
dernieères  Puissances.  Dans  ce  cas,  ces  différends.
seront  réglés  par  ces  tribunaux  nationaux,  à
T’exclusion  du  Tribunal  arbitral  mixte.  Le  ressortissant
  intéressé  Tune  Puissance  alliéce  ou
associèe  pourra  toutelois  porter  TPTaffaire  devant,
le  Tribunal  arbitral  mixte  à  moins  due  sa  loi

nationale  ne  8y  oppose.

c)  Si  le  nombre  des  affaires  le  justifie,  Tautres
membres  devront  ötre  désignés  pour  qdue  chaque
Tribunal  arbitral  mixte  puisse  se  diviser  en
Plusicurs  sections.  Chacune  de  ces  sections  devra
ötre  composée  ainsi  qu'il  est  dit  ci-dessus.

d)  Chadque  Tribunal  arbitral  mixte  établira

lui-meme  sa  procédure  en  tant  qu'elle  ne  sera  pas

#régléee  par  les  dispositions  de  IAnnezxe  au  présent.
article.  II  aura  pouvoir  pour  fixer  les  dépens  à
payer  par  la  partie  perdante  pour  frais  et  deébours
  de  proecdure.

e)  Chaque  Gourernement  payera  les  honoraires

  du  membre  du  Tribunal  arbitral  mixto  qu'il
nomme  et  de  tout  agent  qu’il  désignera  pour  le
représenter  derant  le  Tribunal.  Les  honoraires  du
Drésident  scront  fixés  par  accord  special  entre  les
Gouvernements  intéressés  et  ces  honoraires  ainsi
quo  les  dépenses  communes  de  chadue  Tribunal
seront  payées  par  moitié  par  les  deux  Gouvernemente.

(5)  The  Mizxed  Arbitral  Tribunals  established
pursuent  to  paragraph  (a),  shall  decide  all
questions  within  their  competence  under  Sections
III,  IV.  V  and  VII.  .

In  addition,  all  questions,  whatsoever  thoir
nature,  relating  to  contracts  concluded  bofore  the
coming  into  force  of  the  present  Treaty  betwecn
nationals  of  the,  Allied  and  Associated  Powers
and  German  nationals  shall  be.  decided  by  the
Mixrxed  Arbitral  Tribunal,  always  ercepting
questions  which,  under  the  laws  of  the  Allied,
Associated  or  Neutral  Powers,  are  within  the
jurisdiction  of  the  National  Courts  of  those
Powers.  Such  questions  shall  be  decided  by  tho
National  Courts  in  question,  to  the  exclusion  of
the  Mixed  Arbitral  Tribunal.  The  party  who  is  à
national  of  an  Allied  or  Associated  Power  may
nevertheless  bring  the  case  before  the  Mited
Arbitral  Tribunal  if  this  is  not  prohibited  by  the
laws  of  his  country.

(e)  II  the  number  of  cases  justilles  it.
additional  members  shall  be  appointed  and  each
Mixed  Arbitral  Tribunal  shall  sit  in  divisions.
Each  of  these  divisions  will  be  constituted  as
above.

(d)  Each  Mixed  Arbitral  Tribunal  will  settlo
its  own  procedure  except  in  so  far  as  it  is  provided
in  the  following  Annex,  and  is  empowered  to
award  the  sums  to  be  paid  by  tho  loser  in  respect
of  the  costs  and  expenses  ol  the  proceedings.

(e)  Each  Government  will  pay  the  remuncration
  of  the  member  of  the  Aixed  Arbitral
Tribunal  appointed  by  it  and  of  any  agent  whom
it  may  appoint  to  represent  it  besorc  the  Tribunal.
The  remuneration  of  the  President  will  be  determined
  by  special  agreement  between  the  Governments
  concerned;  and  this  remuneration  and  the
joint  expenses  of  each  Tribunal  will  be  paid  by
the  two  Governments  in  equal  moieties.
