Artiche  306.

Sous  réservo  deg  stipulations  du  présent
Traité,  les  droits  de  propriété  industrielle,  littéraire
  ou  artistiquc,  telle  due  cette  propriété  est
définic  par  les  Conventions  internationales  de  Paris
  ci  cle  Berne  visées  à  I’article  286,  scront  rétabUlis
  ou  restaurés,  à  partir  de  la  mise  en  vigucur  du
présent  Traité  dans  les  territoires  des  Hautes
PTarties  Contractantes,  en  faveur  des  personnes
qui  en  étaient  bénéficiaires,  au  moment  ou  T’état
de  guerre  a  commencdé  d’exister,  ou  de  leurs
uyants  droit.  De  méme  les  droits  qui,  si  la  guerre
’avait  pas  cu  lieu,  auraient  pu  étre  acquis  pendant
  la  durée  de  la  guerre,  à  la  suite  d’une
demande  formée  pour  la  protection  de  la  propriété
  industrielle  ou  de  la  publication  d'une
vuvre  littéraire  ou  artistique,  seront  reconnus
et  Glablis  en  faveur  des  personnes  qui  y  auraient
des  titres,  à  partir  de  la  mise  en  vigucur  du
présent  Traité.

Toutefois,  les  acles  faits  en  vertu  des
mesures  spéciales  qui  auront  été  prises  pendant
la  guerre,  par  uno  autorité  Ié6gislative,  exécutive
oOu  administratire  d’'une  Puissance  allice  ou
unssocice  à  Iégard  des  droits  des  ressortissants
allemands,  en  matière  de  propriété  industrielle,
littcraire  ou  artistiqgue  demeureront  valables  et
contimueront  à  avoir  leurs  pleins  elfets.

II  y  aura  lieu  à  aucunc  rovendication  ou
action  de  la  part  de  l'ALomagne  ou  des  ressortissunis
  allemands  contre  T’utilisation  qui  aurait
Oté  faite  pendant  la  durce  de  la  guorre,  par  le
Gourernement  d’une  Puissance  alliée  ou  associée
nu  Jar  toute  personne,  pour  le  compte  de  ce
(iourernement,  ou  avec  son  assentiment,  de  droits
de  propriété  industrielle,  litteraire  ou  artistique,
ni  contre  la  vente,  la  mise  en  vente  ou  l’emploi
de  produits,  apparoils,  articIes  ou  objets  quelconques
  auxquels  s'appliquaient  ces  droits.

INDUSTRIAL,  PROPERTT.

Article  306.

Subject  to  the  stipulations  of  the  present
Treaty,  rights  of  industrial,  literary  and  artistie
property,  as  such  property  is  defined  by  the  International
  Conventions  of  Paris  and  of  Berne,
mentioned  in  Article  286,  shall  be  re-established  or
restored,  as  from  the  coming  into  force  of  the  present
  Treaty,  in  the  territories  of  the  Iligh  Contracting
  Parties,  in  favour  ol  the  persons  entitled  to
ihe  benefit  of  them  at  the  moment  when  the  stale
of  war  commenced  or  their  legal  representatives.
Equally,  rights  which,  except  for  the  war,  would
have  been  acquired  during  the  war  in  consequenco
of  an  application  made  for  the  protection  of
industrial  property,  or  the  publication  of  a
literary  or  artistic  work,  shall  be  recognised  and
established  im  favour  of  those  persons  who  would
have  been  entitled  thereto,  from  the  coming  into

force  of  the  present  Treaty.

Nevertheless,  all  acts  done  by  virtue  of  the
special  measures  taken  during  the  war  under
legislative,  executive  or  administrative  authority
of  any  Allied  or  Associated  Power  in  regard  to
the  rights  of  German  nationals  in  industrial,
literary  or  artistic  property  shall  remain  in
force  and  shall  continue  to  maintain  their  full
offoct.

No  claim  shall  be  made  or  action  brought  by
Germany  or  German  nationals  in  respect  of  the
use  during  the  war  by  the  Government  of  any
Allied  or  Asscciated  Power,  or  by  any  Dersons
acting  on  behalf  or  with  the  assent  of  such  Government,
  of  any  rights  in  industrial,  literary  or
artistic  property,  nor  in  respect  of  the  sale.
offering  for  sale,  or  use  of  any  products,  articles
or  apparatus  whatsoever  to  which  such  rights
applied.  F
