par  la  Section  VI  de  la  présente  Partie.  Le  Tribunal
pDourra,  S'il  y  a  lieu,  lixer  alors  lo  montant  des
redevances  qui  lui  paraftraient  justifiées,  en  raison
do  P’utilisation  des  droits  pendant  la  durée  de  la
guorre.

Les  licences  rolatives  à  des  droits  de  propriété
industrielle,  littéraire  ou  artistique  qui  auront  6té
concédes  suivant  la  législation  spéciale  de  guerre
d'une  Puissance  alliéo  ou  associée  ne  pourront  se
(rouver  atteintes  par  la  continuation  T’une  licence
oxist  ant  avant  la  guerre,  mais  elles  demeureront
valables  ot  continueront  à  avoir  leurs  pleins  effets,
et  dans  le  cas  ou  uno  de  ces  licences  aurait  été
nccordée  au  bénceficiaire  primitif  d'un  contrat  de
licence  passé  avant  la  guerre,  elle  sera  considérée
Ccomme  s’y  substituant.

Lorsquc  des  sommes  auront  été  payccs  pendant
  la  gucrre,  en  vertu  de  contrat  ou  licence
quclconqucs  intervenus  avant  la  guerre  pour
Texploitation  des  droits  de  propriéts  industriclle
ou  pour  la  reproduction  ou  la  représentation
d'œuvres  littéraires,  dramatiqucs  ou  artistiques,
ces  sommes  recerront  Ia  méme  affectation  due  los
autres  dettes  ou  créances  des  ressortissants  allemands,
  conformément  au  présent  Traité.

Cet  article  ne  sera  pas  applicable  aux  rapports
entro  les  Etats-Unis  d-Amérique,  d’une  part,  et
FAllemagne,  d’autre  part.

Les  habitants  des  territoires  séparés  de  I'Allemagne
  en  vertu  du  présent  Traité,  conserveront,
nonobstant  celte  séparation  et  le  changement  de
nationalité  qui  en  résultera,  la  pleino  et  entière
iouissanco  en  Allemagno  do  tous  les  droits  de  propricté
  industrielle  ct  do  proprieté  littéraire  et
artistiquc,  dont  ils  étaient  titulnires  suivant  la
IGgislation  allemande,  au  moment  de  cette  séparation.

under  German  law.  In  such  cases  the  conditions
ehall  be  fikred  by  the  Mixed  Arbitral  Tribunal
referred  to  in  Section  VI  of  this  Part.  Tho  trihunal
  may,  if  necessary,  fik  also  the  amount
which  it  may  deem  just  should  be  paid  by  reason
of  the  use  of  the  rights  during  the  war.

No  liconce  in  respect  of  industrial,  literary
or  artistic  property,  granted  under  the  special
war  logislation  of  any  Allied  or  Asscociated
Power,  shall  be  affected  by  tho  continued
existence  of  any  licence  entered  into  belsore  tho
war,  but  shall  remain  valid  and  of  full  elkect,  and
a  licence  so  granted  to  the  former  beneficiary  ol
a  licence  entered  into  before  the  war  shall  bo
considered  as  substituted  for  such  licence.

Where  sums  have  been  paid  during  the  war
by  virtue  of  a  licence  or  agreement  conecluded
before  the  war  in  respect  of  rights  of  industrial
Droperty  or  for  the  reproduction  or  the  representation
  of  literary,  dramatic  or  artistic  works,
these  sums  shall  be  dealt  with  in  the  samo
manner  as  other  debts  or  credits  of  German
nationals,  as  provided  by  the  present  Treatpy.

This  Article  shall  not  apply  as  between  the
Unitod  States  of  America  on  the  one  hand  and
Germany  on  tbe  other.

Article  311.

The  inhabitants  of  territories  separated  from
Germany  by  virtue  of  the  present  Treaty  shall
notwithstanding  this  separation  and  the  change
of  nationality  consequent  thereon,  continue  L
enjoy  in  Germany  all  the  rights  in  industrial,
literary,  and  artistic  property  to  which  they  wero
ontitled  under  German  legislation  at  the  timo  ok
the  separation.
