enlés  dans  les  ports  allemands  du  Rhin  après  les
ꝓrélòvements  à  opérer  à  titre  de  restitulion  ou  de
réöparation,  soit  des  parts  intéréèts  dans  les  Sociétés
  allemandes  de  navigation  sur  le  Khin.

En  cas  de  cession  de  bateaux  et  remorqueurs,
ceux-ci,  munis  de  leurs  agrès  et  apparaux,  devront
ötre  en  bon  état,  capables  d’assurer  le  trafic  commercial
  sur  le  Rhin  et  choisis  parmi  les  plus
Trecemment  construils.

Les  memes  regles  seront  applicables  en  ce  qui
concerne  la  cession  par  IAllemagne  à  la  France:

10  des  installations,  poste")  de  stationnement,
terre-pleins,  docks,  magasins,  outillages,  etc.,  que
les  nationaux  allemands  ou  les  scciétés  allemandes
  possédaient  dans  le  port  de  Rotterdam  au
1er  aoüt  1914;

20  des  Participations  ou  intérsts  qdue  DAllemagne
  ou  ses  nationaux  avaient,  à  la  méme  date,
dans  lesdites  installations.

Le  montant  et  le  détail  de  ces  cessions  seront
déterminés,  eu  égard  aux  besoins  légitimes  des
Parties  intéressées,  par  un  ou  plusicurs  arbitres
désignés  par  les  Etats-Unis  d’Amérique,  dans  le

délai  d’un  an  après  la  mise  en  vigueur  du  présent

Traite.

Les  cessions  prévues  au  présent  article  donneront
  lieu  à  une  indemnitc,  dont  le  montant  global,
fixé  forfaitairement  par  PTarbitre  ou  les  arbitres,
ne  pourra,  en  aucun  cas,  dépasser  la  valeur  du
capital  de  premier  stablissement  du  matériel  et
des  installations  cédés,  et  scra  imputable  sur  le
montant  des  sommes  dues  par  PAllemagne;  il
appartiendra  à  PAllemagne  T’indemniser  les  pro-Priétaires.


Article  358.

Moyennant  Tobligation  de  se  confcrmer  aux
stipulations  de  la  Convention  de  Mannheim,  ou  de

man  Rhine  ports  after  the  deduction  of  those
surrendered  by  way  of  restitution  or  reparation,
or  shares  in  German  Rhine  navigation  companies.

When  vessels  and  tugs  are  ceded,  such  vessels
and  tugs,  together  with  their  fittings  and  gear,
shall  be  in  good  state  of  repair,  shall  be  in  condition
  to  carry  on  commercial  traffic  on  the
Rhine,  and  shall  be  selccted  from  among  those
most  recently  built.

The  same  procedure  shall  be  followed  in  the

matter  of  the  cession  by  Germany  to  France

ol:

(1)  the  installations,  berthing  and  anchorage
accommodation,  platforms,  docks,  warehouses,
plant,  etc.,  which  German  subjects  or  German
companies  owned  on  August  1,  1914,  in  the
Port  af  Rotterdam,  and

(2)  the  shares  or  interests  which  Germany  or
German  nationals  possessed  in  such  installations
at  the  same  date.

The  amount  and  specifications  of  such  cessions
  shall  be  determined  within  one  year  of  the
coming  into  force  of  the  present  Treaty  by  an
arbitrator  or  arbitrators  appointed  by  the  United
States  of  America,  due  regard  being  had  to  the
legitimate  needs  of  the  parties  concerned.

The  cessione  provided  for  in  the  present  ArticIe
  shall  entail  a  credit  of  which  the  total
amount,  settled  in  a  lump  sum  by  the  arbitrator
or  arbitrators  mentioned  above,  shall  not  in  any
case  exceed  the  value  of  the  capital  expended  in
the  initial  establishment  of  the  ceded  material
and  installations,  and  shall  be  set  off  against  tho
total  sums  due  from  Germany;  in  consequence,
the  indemnification  of  the  proprietors  shall  be
a  matter  for  Germany  to  doal  with.
