85.

La  valeur  des  propriétés  ainsi  cédées  à  l'Dtat
frangais  sera  déterminée  par  la  Commission  des
réparations  préwue  à  F’article  233  de  la  Partie  VIII
(Réparations)  du  présent  Traité.

Cette  valeur  sera  portée  au  crédit  de  I’Allemagne
dans  le  compte  des  réparations.

II  appartiendra  à  I’  Allemagne  d’indemniser  les
Propriétaires  ou  intéressés,  duels  qu’ils  soient.

86.

Aucun  tarif  ne  sera  établi  sur  les  chemins  de
fer  et  canaux  allemands,  qui  puisse,  par  des  discriminations
  directes  ou  indirectes,  porter  préjudice
  au  bransport  du  personnel,  des  produits  des
mines  et  de  leurs  dépendances,  ou  des  matières
nécessaires  à  leur  exploitation.  Ces  transports
jouiront  de  tous  les  droits  et  privileges  que  des
conventions  internationales  sur  les  chemins  de  fer
Pourraient  garantir  aux  produits  similaires  d’origine
  française.

87.

Le  matériel  et  le  personnel  nécessaires  à  l'évacuation
  et  au  transport  des  produits  des  mines
et  de  leurs  dépendances,  ainsi  du’au  transport  des
ouvriers  et  employés,  seront  procurés  par  l'administration
  des  chemins  de  fer  du  Bassin.

88.

Aucun  obstacle  ne  sera  apporté  aux  travaux
complémentaires  de  voies  ferrees  ou  de  voies  d’eau
due  I’Etat  français  jugerait  nécessaires  pour  assurer
Févacuation  et  le  transport  des  produits  des  mines
et  de  leurs  dépendances,  tels  que  doublement  des
voies,  agrandissements  des  gares,  construction  de
chantiers  et  dépendances.  La  répartition  des  frais
sera,  en  cas  de  désaccord,  soumise  à  un  arbitrage.

L’Etat  français  pourra  de  méme  Ctablir  toutes
nouvelles  voies  de  communication,  ainsi  due  les
routes,  canalisations  Glectrigues  et  liaisons  té1léphoniques
  du’il  jugera  nécessaires  pour  les  bescins
de  Pexploitation.

I1  exploitera  librement,  sans  aucune  entrave,
les  voies  de  Ccommunication  dont  il  sera  propriétaire,
  en  particulier  celles  reliant  les  mines  et  leurs
dépendances  aux  voies  de  communication  situces
en  territoire  français.

89.

L'Etat  français  pourra  toujours  requérir  l'application
  des  lois  et  réglements  miniers  allemands,
en  vigueur  au  11  novembre  1918  (réserve  faite  des
dispositions  exclusivement  prises  en  vue  de  l'état
de  guerre),  pour  Dacquisition  des  terrains  du’'il
jugera  nécessaires  à  P’exploitation  des  mines  et  de
leurs  dépendances.

The  value  of  the  property  thus  ceded  to  the
French  State  will  be  determined  by  the  Reparation
  Commission  referred  to  in  Article  233  of  Part
VIII  (Reparation)  of  the  present  Treaty.

This  value  shall  be  credited  to  Germany  in
part  payment  of  the  amount  due  for  reparation.

It  will  be  for  Germany  to  indemnify  the  proprietors
  or  parties  concerned,  whoever  they  may  be.

No  tariff  shall  be  established  on  the  German
railways  and  canals  which  may  directly  or  indirectly
  discriminate  to  the  prejudice  of  the  transport
  of  the  personnel  or  products  of  the  mines  and.
their  accessories  or  subsidiaries,  or  of  the  material
necessary  to  their  exploitation.  Such  transport
shall  enjoy  all  the  rights  and  privileges  which
any  international  railway  conventions  may  guarantee
  to  similar  products  of  French  origin.

7.

The  equipment  and  personnel  necessary  to  ensure
the  despatch  and  transport  of  the  products  of
the  mines  and  their  accessories  and  subsidiaries,
as  well  as  the  carriage  of  workmen  and  employees,
will  be  provided  by  the  local  railway  administration
  of  the  Basin.

No  obstacle  shall  be  placed  in  the  way  of  such
improvements  of  railways  or  waterways  as  the
French  State  may  judge  necessary  to  assure  the
despatch  and  the  transport  of  the  products  of
the  mines  and  their  accessories  and  subsidiaries,
such  as  double  trackage,  enlargement  of  stations,
and  construction  of  yards  and  appurtenandces.
The  distribution  of  expenses  will,  in  the  event  of
disagreement,  be  submitted  to  arbitration.

The  French  State  may  also  establish  any  new
means  of  communication,  such  as  roads,  electrio
lines  and  telephone  Connections  which  it  may
consider  necessary  for  the  exploitation  of  the  mines.

It  may  exploit  freely  and  without  any  restrictions
  the  means  of  communication  of  which  it
may  become  the  owner,  particularly  those  connecting
  the  mines  and  their  accessories  and  subsidiaries
with  the  means  of  communication  situated  in
French  territory.

9.

The  French  State  shall  always  be  entitled  to
demand  the  application  of  the  German  mining
laws  and  regulations  in  force  on  November
11  1918,  excepting  provisions  adopted  exclu-Sively
  in  view  of  the  state  of  war,  with  a  view  to.
the  acquisition  of  such  land  as  it  may  judge
necessary  for  the  exploitation  of  the  mines  and
their  accessories  and  subsidiaries.
