Si,  à  la  suite  du  rachat  prévu  au  paragraphe  36,
la  propriété  des  mines  ou  d'une  partie  des  mines
est  transférée  à  IAllemagne,  I’Etat  et  les  nationaux
françgais  auront  le  droit  d’acheter  la  quantité  de
charbon  du  Bassin,  justifice  par  leurs  bescoins  industriels
  et  domestiques  à  cette  date.  Un  arrangement
  Cquitable  Gtabl  en  temps  utile  par  le  Conseil
de  la  Société  des  Nations,  fixera  les  quantités  de
charbon  et  la  durée  du  contrat,  ainsi  due  les
Prix.

g  38.

II  est  entendu  que  la  France  et  l'Allemagne
Pourront,  par  des  accords  particuliers  conclus
Avant  la  date  fixée  pour  le  payement  du  prix  de
rachat  des  mines,  déroger  aux  dispositions  des
Paragraphes  36  et  37.

g  39.

Le  Conseil  de  la  Société  des  Nations  prendra
les  dispositions  requises  bour  Torganisation  du
régime  à  instaurer  apres  la  mise  en  vigueur  des
déeisions  de  la  Sociécte  des  Nations  mentionnées
au  paragraphe  35.  Ces  dispositions  Comprendront
une  répartition  Cquitable  de  toutes  obligations
incombant  au  Gouvernement  du  Bassin  de  la
Sarre,  à  la  suite  d'’emprunts  levés  par  la  Commission
  ou  à  la  suite  de  toute  autre  mesure.

Des  la  mise  en  vigueur  du  nouveau  régime,
les  pouvoirs  de  la  Commission  de  Gouvernement
prendront  fin,  sauf  dans  le  cas  prévu  par  le  paragraphe
  35a).

z  40.

Dans  les  matiéres  visées  dans  la  présente  Annexe,
les  décisions  du  Conseil  de  la  Société  des  Nations
seront  prises  à  la  majorité.

SECTION  V.
ALSACE-LORRAINE.

Les  Hautes  Parties  Contractantes,  ayant  reconnu
Pobligation  morale  de  réparer  le  tort  fait  par
Allemagne  en  1871,  tant  au  droit  de  la  France
u'  à  la  volonté  des  populations  d'Alsace  et  de
rraine,  séparées  de  leur  Patrie  malgré  la  protestation
  solennelle  de  leurs  représentants  à  ’Assemblee
  de  Bordeauz,
Sont  d’'accord  sur  les  articles  suivants:

37.

If,  in  consequence  of  the  repurchase  provided
for  in  paragraph  36,  the  ownership  of  the  mines
or  any  part  of  tbem  is  transferred  to  Germany,
the  French  State  and  French  nationals  shall  have
the  right  to  purchase  such  amount  of  coal  of  the
Saar  Basin  as  their  industrial  and  domestic  needs
are  found  at  that  time  to  require.  An  equitable
arrangement  regarding  amounts  of  coal,  duration
of  contract,  and  prices  will  be  fixed  in  due  time
by  the  Council  of  the  League  of  Nations.

38.

It  is  understoocd  that  France  and  Germany,
may  by  special  agreements  concluded  before  the
time  fixed  for  the  payment  of  the  price  for  the
repurchase  of  the  mines,  modify  the  provisions  of
Paragraphs  36  and  37.

39.

The  Council  of  the  League  of  Nations  shall
make  such  provisions  as  may  be  necessary  kor  the
establighment  of  the  régime  which  is  to  take
effect  after  the  decisions  of  the  League  of  Nations
mentioned  in  Article  35  have  become  operative,
including  an  uitable  apportionment  of  any
obligations  of  the  Government  of  the  territory
of  the  Saar  Basin  arising  from  loans  raised  by
the  Commission  or  from  other  causes.

From  the  coming  into  force  of  the  new  régime,
the  powers  of  the  Governing  Commission  wi

terminate,  except  in  the  case  provided  for  in
Paragraph  35  (a).

40.

In  all  matters  dealt  with  in  the  present  Annex,
the  decisions  of  the  Council  of  the  League  of
Nations  will  be  taken  by  a  majority.

SECTLON  V.
ALSACE-LORRAINE.

The  High  Contracting  Parties,  recognising  the
moral  obligation  to  redress  the  wrong  done  by
Germany  in  1871  both  to  the  rights  of  France
and  to  the  wishes  of  the  population  of  Alauco
and  Lorraine,  which  were  separated  from  their
country  in  spite  of  the  solemn  protest  of  theie
representativesn  at  the  Assembly  of  Bordeauz,
agree  upon  the  following  articles:
