Article  65.

Dans  un  dlai  de  trois  semaines  après  la  mise
en  vigueur  du  présent  Traité,  le  port  de  Strasbourg
et  le  port  de  Kehl  seront  constitués,  pour  une
durée  de  sept  années,  en  un  organisme  unique  au
point  de  vue  de  I’exploitation.

L’administration  de  cet  organisme  unique  sera
assurée  par  un  directeur  nommé  par  la  Commission
  centrale  du  Rhin  et  révocable  par  elle.

Ce  directeur  devra  Stre  de  nationalité  française.

I1  sera  soumis  au  contröle  de  la  Commission
centrale  du  Rhin  et  résidera  à  Strasbourg.

II  sera  établi,  dans  les  deux  ports,  des  zones
franches,  conformément  à  la  Partie  XII  (Ports,
Voies  d’eau  et  Voies  ferrées)  du  présent  Traité.

Une  Convention  particulière,  à  intervenir  entre
la  France  et  I'/Allemagne,  et  qui  sera  soumise
à  Papprobation  de  la  Commission  centrale  du
Rhin,  döterminera  les  modalités  de  cette  organisation,
  notamment  au  point  de  vue  financier.

II  est  entendu  qu'aux  termes  du  présent  article,
  le  port  de  Kehl  comprend  I’ensemble  des
surfaces  nécessaires  au  mouvement  du  port  et
des  trains  le  desservant,  y  compris  les  bassins,

uais  et  voies  ferrées,  terre-pleins,  grues,  halls

quais  et  d’entrepöts,  silos,  41évateurs,  usines
hydro-Gdectriques,  constituant  Toutillage  du  port.

Le  Gouvernement  allemand  s'engage  à  prendre
  toutes  dispositions  dui  lui  seront  demandées
en  vue  d'’assurer  que  toutes  les  formations  et  manceuvres
  de  trains  à  destination  ou  en  provenance
de  Kebl,  relatifs  tant  à  la  rive  droite  qu'à  la  rive
gauche  du  Rhin,  scient  effectuées  dans  les  meilleures
  conditions  possibles.

Tous  les  droits  et  propriétés  des  particuliers
seront  sauvegardés.  En  particulier,  I’administration
  des  ports  s'abstiendra  de  toute  mesure  préjadieiable
  aux  droits  de  propriété  des  chemins  de
er  français  ou  badois.

L'égalité  de  traitement,  au  point  de  vue  du
trafic,  sera  assurée  dans  les  deux  ports  aux  nationaux,
  bateaux  et  marchandises  de  toutes  nationalités.


Au  cas  où  à  l’expiration  de  la  sixième  annéße,
la  France  estimerait  que  I’état  d’avancement  des
travaux  du  port  de  Strasbourg  rend  nécessaire
une  prolongation  de  ce  régime  transitoire,  elle
aura  la  faculté  d'’en  demander  la  prolongation  à
la  Commission  centrale  du  Rhin  qui  pourra  l'accorder
  pour  une  période  ne  dépassant  pas  trois  ans.

Pendant  toute  la  durée  de  la  prolongation,  les
zones  franches  prévues  ci-dessus  seront  maintenues.

Article  65.

Within  a  Ferioc  #of  three  weeks  after  the  coming
into  force  of  the  present  Tfatf=  the  port  of  Strasburg
  and  the  port  of  Kehl  shall  be  constituted,
for  a  period  of  seven  Fears,  a  single  unit  from  the
Point  of  view  of  exploitation.

The  administration  of  this  single  unit  will
be  carried  on  by  a  manager  named  by  the  Central
BRhine  Commission,  which  shall  also  have  power
to  remove  him.

This  manager  shall  be  of  French  nationality.

He  will  reside  in  Strasburg  and  will  be  subjeot
to  the  supervision  of  the  Central  Rhine  Commission.

There  will  be  established  in  the  two  ports  free
zones  in  conformity  with  Part  XII  (Ports,  Waterways
  and  Railways)  of  the  present  Treaty.

A  special  Convention  between  France  and
Germany,  which  shall  be  submitted  to  the  aproval

  of  the  Central  Rhine  Commission,  will
ix  the  details  of  this  organisation,  particularly
as  regards  finance.

It  is  understood  that  for  the  purpose  of  the
Present  article  the  port  of  Kehl  includes  the
whole  of  the  area  necessary  for  the  movements
of  the  port  and  the  trains  which  serve  it,  including
  the  harbour,  quays  and  railroads,  platforms,
cranes,  sheds  and  warehouses,  silos,  elevators
and  hydro-electric  plants,  which  make  up  the
equipment  of  the  port.

The  German  Government  undertakes  to  carry
out  all  measures  which  shall  be  required  of  it  in
order  to  assure  that  all  the  making-up  and  switching
of  trains  arriving  at  or  departing  from  Kehl,
whether  for  the  right  bank  or  the  left  bank  of  the
Rhine,  shall  be  carried  on  in  the  best  conditions
Possible.

All  property  rights  shall  be  safeguarded.  In
Particular  the  administration  of  the  ports  shall
not  prejudice  any  property  rights  of  the  French
or  Baden  railroads.

Equality  of  treatment  as  respects  traffic  shall

be  assured  in  both  ports  to  the  nationals,  vessels
and  goods  of  every  country.

In  case  at  the  end  of  the  sixth  year  France
shall  consider  that  the  progress  made  in  the  im-Provement
  of  the  port  of  Strasburg  still  requires
a  prolongation  of  this  temporary  régime,  she  may
ask  for  such  prolongation  from  the  Central  Rhine
Commission,  which  may  grant  an  extension  for
a  pPeriod  not  exceeding  three  Fears.

Throughout  the  whole  period  of  any  such  extension
  the  free  zones  above  provided  for  shall
be  maintained.  4
