PARTIE  VII.
SANCTIONS.

Article  227.

Les  Puissances  alliées  et  associées  mettent  en
acousation  publique  Guillaume  II  de  Hohenzollern,
e#empereur  d’Allemagne,  pour  offense  supréme
contre  la  morale  internationale  et  D’autorité  sacrée
des  traités.

Un  Tribunal  spécial  sera  constitué  pour  juger
T’accusé  en  lui  assurant  les  garanties  essentielles
du  droit  de  defense.  II  sera  composé  de  cindq  juges,
nommés  par  chacune  des  cind  Puissances  suivantes,
  savoir:  les  Etats-Unis  d'Amérique,  la
Grande-Bretagne,  la  France,  P’Italie  et  le  Japon.

Le  Tribunal  jugera  sur  motifs  inspirés  des  principes
  les  plus  deves  de  la  politique  entre  les  nations
eavec  le  souci  d’assurer  le  respect  des  obligations
solennelles  et  des  engagements  internationaux
ainsi  que  de  la  morale  internationale.  II  lui  appartiendra
  de  déterminer  la  peine  qu’il  estimera
devoir  stre  appliquée.

Les  Puissances  allices  et  associées  adresseront
au  Gouvernement  des  Pays-Bas  une  requste  le
priant  de  livrer  Pancien  empereur  entre  leurs
mains  pour  qu’il  scit  jugé.

Article  228.

Le  Gouvernement  allemand  reconna#t  aux  Puissances
  alliées  et  associées  la  liberté  de  traduire
devant  leurs  tribunaux  militaires  les  personnes
saccusées  d’avoir  commis  des  actes  contraires  aux
lois  et  coutumes  de  la  guerre.  Les  peines  prévues
par  les  lois  seront  appliquées  aux  personnes  reconnues
  coupables.  "
nonobstant  toutes  procédures  ou  poursuites  devant
une  juridiction  de  I’Allemagne  ou  de  ses  alliés.

Le  Gouvernement  allemand  devra  livrer  aux
Purissances  alliées  et  asscociées,  ou  à  celle  d’entre
elles  qui  lui  en  adressera  la  requste,  toutes  personnes
  qui,  Ctant  accusées  d'avoir  commis  un  acte
ontraire  aux  lois  et  coutumes  de  la  guerre,  lui
seraient  désignées  soit  nominativement,  soit  par
le  grade,  la  fonction  ou  l’emploi  auxquels  les  personnes
  auraient  é6té  affectées  par  les  autorités
allemandes.

Article  229.

PART  VII.
PENALTIES.

Article  227.

The  Allied  and  Associated  Powers  publicly
arraign  William  II  of  Hohenzollern,  formerly
German  Emperor,  for  a  supreme  offence  against
international  morality  and  the  sanctity  of  treaties.

A  special  tribunal  will  be  constituted  to  try
the  accused,  thereby  assuring  him  the  guarantees
essential  to  the  right  of  defence.  It  will  be  com-Posed
  of  five  judges,  one  appointed  by  each  of
the  following  Powers:  namely,  the  United  States
er  America,  Great  Britain,  France,  Italy,  and

apan.

In  its  decision  the  tribunal  will  be  guided  b
the  hirhest  motives  of  international  policy,  wit
a  view  to  vindicating  the  solemn  obligations  of
ngs  and  the  validity  of
international  morality.  It  will  be  its  duty  to  fix
the  punishment  which  it  considers  should  be
imposed.

The  Allied  and  Asscciated  Powers  will  address
  a  request  to  the  Government  of  the  Netherlands
  for  the  surrender  to  them  of  the  ex-Emperor
in  order  that  he  may  be  put  on  trial.

Article  228.

The  German  Government  recognises  the  right
of  the  Alied  and  Aescciated  Powers  to  bring
before  military  tribunals  persons  accused  of

having  committed  acts  in  violation  of  the  laws

and  customs  of  war.  Such  persons  shall,  if  found.
guilty,  be  sentenced  to  punishments  laid  down.
by  law.  This  provision  will  apply  notwithstanding
any  proceedings  or  prosecution  before  a  tribunal
in  Germany  or  in  the  territory  of  her  allies.

The  German  Government  shall  hand  over  to
the  Allied  and  Asscciated  Powers,  or  to  such
one  of  them  as  shall  so  request,  all  persons  accused
#of  having  committed  an  act  in  violation  of  the
laws  and  customs  of  war,  who  are  specified  either
by  name  or  by  the  rank,  office  or  employment
which  they  held  under  the  German  authorities.

Article  229.

Persons  guilty  of  criminal  acts  against  the
nationals  of  one  of  the  Allied  and  Associated
