tissants  seront  examinées  et  le  montant  des  indemnités
  sera  fixé  par  le  Tribunal  arbitral  mizxte
prévu  par  la  Section  VI  ou  par  un  arbitre  désigné
par  ledit  Tribunal;  les  indemnités  seront  à  la  charge
de  I’Allemagne  et  pourront  stre  prélevées  sur  les
biens  des  ressortissants  allemands,  existant  sur
le  territoire  ou  se  trouvant  sous  le  contröle  de
IEtat  du  réclamant.  Ces  biens  pourront  étre
Sonstitués  en  gage  des  obligations  ennemies,  dans
les  conditions  fixées  par  le  paragraphe  4  de  I’Annexe
  ci-jointe.  Le  payement  de  ces  indemnités
pourra  ötre  effectué  par  la  Puissance  alliée  ou  asaociée
  et  le  montant  porté  au  débit  de  l'Allemagne.


f)  Toutes  les  fois  due  le  ressortissant  d'’une
Puissance  allice  ou  associée,  propriétaire  d’un  bien,
droit  ou  intérét  qui  a  fait  Tobjet  d’'une  mesure  de
disposition  sur  le  territoire  allemand  en  exprimera
le  désir,  il  sera  satisfait  à  la  réclamation  prévue  au
paragraphe  e),  lorsque  le  bien  existe  encore  en
nature,  par  la  restitution  dudit  bien.

Dans  ce  cas,  1  Allemagne  devra  prendre  toutes
les  mesures  nécessaires  pour  remettre  le  propriétaire
  éCvincé  en  possession  de  son  bien,  libre  de
toutes  charges  ou  servitudes  dont  il  aurait  été
grevé  apres  la  liquidation,  et  indemniser  tout  tiers
lésé  par  la  restitution.

Si  la  restitution  visée  au  présent  paragraphe
ne  peut  Stre  effectué,  des  accords  particuliers,  négociés
  par  F’intermédiaire  des  Puissances  intéresséces
  ou  des  Offices  de  vérification  et  de  compPensation
  visés  à  IAnnezxe  jointe  à  la  Section  III,
Pourront  intervenir  pour  assurer  que  le  ressortissant
  d’'une  Puissance  allice  ou  associée  soit  indemnisé
  du  préjudice  visé  au  paragraphe  e)  par
Tattribution  d’avantages  ou  d’équivalents,  qu'il
consent  à  accepter  en  représentation  du  bien,  des
droits  ou  des  intéréts  dont  il  a  été  Gvincé.

En  raison  des  restitutions  effectusées  conformément
  au  présent  article,  les  prix  ou  indemnités
fixés  par  application  du  Paragraphe  e)  seront  diminués
  de  la  valeur  actuelle  du  bien  restitué,
compte  tenu  des  indemnités  pour  privation  de
jouissance  ou  détérioration.

g)  La  faculté  prévue  au  paragraphe  f)  est  réser-Vée
  aux  propriétaires  ressortissants  des  Puissances
allices  ou  associées  sur  le  territoire  desquels  des
mesures  Igislatives,  ordonnant  la  liquidation
générale  des  biens,  droits  ou  intérsts  ennemis,
n’étaient  pas  en  application  avant  la  signature  de
J’Armistice.

h)  Sauf  le  cas  où,  par  application  du  paragraphe
  f),  des  restitutions  en  nature  ont  été  effectuées,
  le  produit  net  des  liquidations  de  biens,
droits  et  intéréts  ennemis  où  qu’ils  aient  été  situss,
  faites  soit  en  vertu  de  la  IEgislation  exceptionnelle
  de  guerre,  soit  par  application  du  présent
article  et  genéralement  tous  les  avoirs  en  numéraire
  des  ennemis  rece  vront  Lffectation  suivante:

be  investigated,  and  the  total  of  the  compensation
shall  be  determined  by  the  Mixed  Arbitral  Tribunal
  provided  for  in  Section  VI  or  by  an  Arbitrator
  appointed  by  that  Tribunal.  This  com-Pensation
  shall  be  borne  by  Germany,  and  may  be
charged  upon  the  property  of  German  nationals
within  the  territory  or  under  the  control  of  the
claimant's  State.  This  property  may  be  constituted
  as  a  pledge  for  enemy  liabilities  under  the
conditions  fixed  by  paragraph  4  of  the  Annex
hereto.  The  payment  of  this  compensation  may
be  made  by  the  Allied  or  Associated  State,  and
the  amount  will  be  debited  to  Germany.

(f)  Whenever  a  national  of  an  Allied  or  Associated
  Power  is  entitled  to  property  which  has
been  subjected  to  a  measure  of  transfer  in
German  territory  and  expresses  a  desire  for  its
restitution,  his  claim  for  compensation  in  accordance
  with  paragraph  (e)  shall  be  satisfied  b
the  restitution  of  the  said  property  if  it  sti
exists  in  specie.

In  such  case  Germany  shall  take  all  necessary
steps  to  restore  the  evicted  owner  to  the  possession
  of  his  property,  free  from  all  encumbrances
  or  burdens  with  which  it  may  have  been  charged
  after  the  liquidation,  and  to  indemnify  all
third  parties  injured  by  the  restitution.

If  the  restitution  provided  for  in  this  paragraph
  cannot  be  effected,  private  agreements  arranged
  by  the  intermediation  of  the  Powers  concerned
  or  the  Clearing  Offices  provided  for  in  the
Annex  to  Section  III  may  be  made,  in  order  to
secure  that  the  national  of  the  Allied  or  Asscciated
  Power  may  secure  compensation  for  the  injury
  referred  to  in  paragraph  (e)  by  the  grant
of  advantages  or  equivalents  which  he  agrees  to
accept  in  p  ace  of  the  property,  rights  or  interests
  of  which  he  was  deprived.

Through  restitution  in  accordance  with  tbis
article,  the  price  or  the  amount  of  compensation
fixzed  by  the  application  of  paragraph  (e)  will  be
reduced  by  the  actual  value  of  the  property
restored,  account  being  taken  of  compensation  in
respect  of  loss  of  use  or  deterioration.

(68)  The  rights  conferred  by  paragraph  (#)
are  reserved  to  owners  who  are  nationals  of  Allied
or  Asscciated  Powers  within  whose  territory  legis'ative
  measures  pres  ribing  the  general  liquidation
  of  enemy  Proberty,  rights  or  mterests  were
not  applied  before  the  signature  of  the  Armistice.

(h)  Except  in  cases  where,  by  application  of
pPaagraph  (f),  restitutions  in  specie  have  been
made,  the  net  proceeds  of  sales  of  enemy  property,
  rights  or  interests  wherever  situated  carried
  out  either  by  virtue  of  war  legislation,  or  b
application  of  this  Article,  and  in  general  walq
cash  assets  of  enemies,  shall  be  dealt  with  as
follows:
