payement  de  frais,  charges  ou  dépenses,  encaissements
  d'honoraires.

Les  „mesures  de  disposition“  sont  celles  qui  ont
affecte  ou  affecteront  la  propriété  des  biens  ennemis
  en  en  transférant  tout  ou  partie  à  une  autre
personne  due  le  propriétaire  ennemi  et  sans  son
consentement,  notamment  les  mesures  ordonnant
la  vente,  la  liquidation,  la  dévolution  de  propriété
des  biens  ennemis,  I’annulation  des  titres  ou  valeurs
mobilières.

84.

Les  biens,  droits  et  intérsts  des  ressortissants
allemands  dans  les  territoires  d’'une  Puissance
alliéce  ou  associce  ainsi  que  le  produit  net  de  leur
vente,  liquidation  ou  autres  mesures  de  disposition,
  pourront  stre  grevés  par  cette  Puissance
alliéce  ou  associée:  en  premier  lieu,  du  payement
des  indemnités  dues  à  I’occasion  des  réclamations
des  ressortissants  de  cette  Puissance  concernant
leurs  biens,  droits  et  interéts  y  compris  les  sociétés
ou  asscciations  dans  lesquelles  ces  ressortissants
éGtaient  intéressés  en  territoire  allemand  ou  des
eréances  qu’fils  ont  sur  les  ressortissants  allemands
ainsi  que  du  payement  des  réclamations  introduites
Pour  des  actes  Ccommis  par  le  Gouvernement  allemand
  ou  par  toute  autorité  allemande  postérieurement
  au  31  juillet  1914  et  avant  que  cette  Puissance
  alliée  ou  associée  ne  participät  à  la  guerre.
Le  montant  de  ces  sortes  de  réclamations  pourra
être  fixé  par  un  arbitre  désigné  par  M.  Gustave
Ador,  si  celui-ei  y  consent,  ou  à  défaut,  par  le  Tribunal
  arbitral  mixte  prévu  à  la  Section  VI.  Ils
pourront  étre  grevés,  en  second  lieu,  du  payement
des  indemnités  dues  à  T’occasion  des  réclamations
des  ressortissants  de  la  Puissance  alliée  ou  associce
concernant  leurs  biens,  droits  et  intéréts  sur  le
territoire  des  autres  Puissances  ennemies,  en  tant
que  ces  indemnités  n'’ont  pas  été  acquittéees  d’une
autre  mani6re.

85.

Nonobstant  les  dispositions  de  l’article  297
lorsque,  immédiatement  avant  le  début  de  la
guerre,  une  société  autorisée  dans  un  Etat  allié
ou  associé  avait,  em  Commun  avec  une  sociécté  contrölée
  par  elle  et  autorisée  en  Allemagne,  des
droits  à  T’utilisation  dans  d’autres  pays,  de  marques
de  fabrique  ou  commerciales,  ou  lorsqu’felle  avait
la  jouissance  avec  cette  société  de  procédés  exclusifs
de  fabrication  de  marchandises  ou  d’articles  pour
la  vente  dans  I’autre  pays,  la  premiere  société  aura
seule  le  droit  d’'utiliser  ces  marques  de  fabrique
dans  d’autres  pays,  à  I’exclusion  de  la  socicté  allemande;
  et  les  procédés  de  fabrication  communs
seront  remis  à  la  premiere  société  nonobstant  toute
mesure  prise  en  application  de  la  LEgislation  de
guerre  allemande  à  I’égard  de  la  seconde  société  ou
de  ses  intérsts,  proprictés  commerciales  ou  actions.
Néanmoins,  la  premicère  société,  si  demande  lui
en  est  faite,  remettra  à  la  seconde  société  des  mo-320

to  a  person  other  than  the  enemy  owner,  and
without  his  consent,  such  as  measures  directing
the  sale,  liquidation,  or  devolution  of  ownership
in  enemy  property,  or  the  cancelling  of  titles  or
Securities.

All  property,  rights  and  interests  of  German
nationals  within  the  territory  of  any  Allied  or
Asscciated  Power  and  the  net  proceeds  of  their
Sale,  liguidation  or  other  dealing  therewith  may  be
charged  by  that  Allied  or  Asscciated  Power  in  the
first  place  with  payment  of  amounts  due  in  respect
of  claims  by  the  nationals  of  that  Allied  or  Associated
  Power  with  regard  to  their  property,  rigbts
and  interests,  including  companies  and  associations
  in  which  they  are  interested,  in  German
territory,  or  debts  owing  to  them  by  German
nationals,  and  with  payment  of  claims  growing
out  of  acts  Kommitted  by  the  German  Government
or  by  any  German  authorities  since  July  31,
1914,  and  before  that  Allied  or  Associated  Power
entered  into  the  war.  The  amount  of  such  claims
may  be  assessed  by  an  arbitrator  appointed  by
Mr.  Gustave  Ador,  if  he  is  willing,  or  if  no  such
appointment  is  made  by  bim,  by  an  arbitrator
appointed  by  the  Mixed  Arbitral  Tribunal  provided
for  im  Section  VI.  They  may  be  charged  in  the
second  place  with  payment  of  the  amounts  due  in
respect  of  claims  by  the  nationals  of  such  Allied
or  Asscciated  Power  with  regard  to  their  property,
rights  and  interests  in  the  territory  of  other  enemy
Powvers,  in  so  far  as  those  claims  are  otherwise
unsatiskied.

Notwithstanding  the  provisions  of  Article  297,
where  immediately  before  the  outbreak  of  war  a
company  incorporated  in  an  Allied  or  Asscciated
State  had  rights  in  common  with  a  company
Controlled  by  it  and  incorporated  in  Germany  to
the  use  of  trade-marks  in  third  countries,  or  enjoyed
  the  use  in  common  with  such  company  of
unique  means  of  reproduction  of  goods  or  articles
fer  sale  in  third  countries,  the  former  company
shall  alone  have  the  right  to  use  these  trademarks
  in  third  countries  to  the  exclusion  of  the
German  company,  and  these  uniqdue  means  of  reproduction
  shall  be  handed  over  to  the  former
company,  notwithstanding  any  action  taken  under
German  war  legislation  with  regard  to  the  latter
company  or  its  business,  industrial  property  or
shares.  Nevertheless,  the  former  company,  i  requested,
