Article  299.

a)  Les  contrats  conclus  entre  ennemis  seront
considérés  comme  ayant  été  annulés  à  partir  du
moment  on  deux  qduelconques  des  parties  sont
devenues  ennemies,  sauf  en  ce  qui  concerne  les
dettes  et  autres  obligations  pécuniaires  résultant
de  l’exécution  d’un  acte  ou  payement  prévu  par
ces  contrats  et  sous  réserve  des  exceptions  et
des  régles  spéciales  à  certains  contrats  ou  catégories
  de  contrats  prévues  ci-après  ou  dans  l'Annexe
  ci-fointe.

b)  Seront  exceptés  de  I’annulation,  aux  termes
du  présent  article,  les  contrats  dont,  dans  un
intérét  général,  les  Gouvernements  des  Puissances
alliées  ou  asscciées,  dont  l’une  des  parties  est  un
ressortissant,  réclameront  I’exécution,  dans  un
délai  de  six  mois  à  dater  de  la  mise  en  vigueur  du
Présent  Traité.  #  ç

Lorsque  l’exécution  des  contrats  ainsi  maintenus
  entrame,  pour  une  des  parties,  par  suite
du  changement  s  les  conditions  du  commerce,
un  précjudice  considérable,  le  Tribunal  arbitral
mixte  Prévu  par  la  Section  VI  pourra  attribuer
à  la  partie  lésée  une  indemnité  équitable.

c)  En  raison  des  dispositions  de  la  Constitution
  et  du  droit  des  Etats-Unis  d’Amérique,  du
Brésil  et  du  J  apon,  le  présent  article  ainsi  que
l'article  300  et  IAnnexe  ci-Jointe  ne  s’appliquent
pas  aux  contrats  conclus  par  des  ressortissants
de  ces  Etats  avec  des  ressortissants  allemands,
et  de  méme,  l’article  305  ne  s'’applique  pas  aux
Etats-Unis  d'Amérique  ou  à  leurs  ressortissants.

d)  Le  présent  article  ainsi  due  I·Annexe  ci-Jointe
  ne  s'appliquent  pas  aux  contrats  dont  les
parties  sont  devenues  ennemies  du  fait  due  l'une
d'’elle  était  un  habitant  d’un  territoire  qui  change
de  souveraineté,  en  tant  que  cette  partie  aura
acquis,  par  application  du  présent  Traité,  la
nationalité  d’une  Puissance  allice  ou  associée,  ni
aux  contrats  conclus  entre  ressortissants  des
Puissances  alliées  ou  associées  entre  lesquelles  le
commerce  s'est  trouvé  interdit  du  fait  que  P’une

The  provisions  of  Article  297  and  this  Annezx
apply  to  industrial,  literary  and  artistie  property
which  has  been  or  will  be  dealt  with  in  the  liquidation
  of  property,  rights,  interests,  Companies  or
businesses  under  war  legislation  by  the  Allied  or
Asscciated  Powers,  or  in  accordance  with  the
stipulations  of  Article  297,  paragraph  (b).

SECTION  V.
CONTRACTES,  PRESCRIPTIONS,  JoDGMEN#S  43

Article  299.

(a)  Any  contract  concluded  between  enemies
shall  be  regarded  as  having  been  dissoclved  as  from
the  time  when  any  two  of  the  parties  became
enemies,  except  in  respect  of  any  debt  or  other
Pecuniary  obligation  arising  out  of  any  act  done
or  money  paid  thereunder,  and  subject  to  the  erceptions
  and  special  rules  with  regard  to  particular
  contracts  or  classes  of  contracts  contained
herein  or  in  the  Annez  hereto.

(b)  Any  contract  of  which  the  execution  shall
be  required  in  the  general  interest,  within  six
months  from  the  date  of  the  coming  into  force  of
the  present  Treaty,  by  the  Allied  or  Associated
Government  of  which  one  of  the  parties  is  a
national,  shall  be  excepted  from  dissolution  under
this  Article.

When  the  execution  of  the  contract  thus  kept
alive  would,  owing  to  the  alteration  of  trade
conditions,  cause  one  of  the  parties  substantial
prejudice  the  Mixed  Arbitral  Tribunal  provided
for  by  Section  VI  shall  be  empowered  to  grant  to
the  prejudiced  party  equitable  compensation.

(c)  Having  regard  to  the  provisions  of  the
constitution  and  law  of  the  United  States  of
America,  of  Brazil,  and  of  Japan,  neither  the
bresent  articke,  nor  Article  300,  nor  the  annezx
ereto  shall  apply  to  contracts  made  between
nationals  of  these  States  and  German  nationals;
nor  shall  Article  305  apply  to  the  United  States
of  America  or  its  natichla

(d)  The  present  Article  and  the  annex  hereto
shball  not  apply  to  contracts  the  parties  to  which
became  enemies  by  reason  of  one  of  them  being
an  inhabitant  of  territory  of  which  the  sovereignty
  has  been  transferred,  if  such  party  shal.
Sacquire  under  the  present  Treaty  the  nationalit
of  an  Allied  or  Asseciated  Power,  nor  shall  they
apply  to  contracts  between  nationals  of  the
Allied  and  Associated  Powers  between  whom
trading  has  been  prohibited  by  reason  of  one  ot
