Dans  tous  les  cas  où,  en  vertu  de  la  loi  applicable
  au  contrat,  I’assureur  reste  lié  par  le  contrat
nonobstant  le  non-payement  des  primes,  jusqu’'à

du  contrat,  il  aura  le  droit  là  od,  par  suite  de  la

avec  le  taux  d’intérét,  pour  le  calcul  des  engagements
  réciproques  des  deux  parties.

Les  contrats  d’assurance  maritime,  y  compris
les  polices  à  temps  et  les  polices  de  voyage  passées

entre  un  assureur  et  une  personne  devenue  par  la

suite  ennemie,  seront  considérés  comme  annulés
au  moment  où  ette  personne  est  devenue  ennemie,
sauf  dans  le  cas  od,  antérieurement  à  ce  moment,
le  risque  prévu  dans  le  contrat  avait  commencé  à
ötre  couru.

Dans  le  cas  où  le  risque  n'a  pas  Ccommencés  à
courir,  les  sommes  payées  au  mopyen  de  primes  ou
autrement  seront  recouvrables  sur  I’assureur.

Dans  le  cas  où  le  risque  a  commendé  à  courir,
le  contrat  sera  considéré  Comme  valable,  bien  qdue
la  partie  soit  devenue  ennemie,  et  les  payements
des  sommes  dues  aux  termes  du  contrat,  soit  comme
Frimes.  soit  Comme  sinistres,  seront  exigibles  apres
a  mise  en  vigueur  du  présent  Traité.

Dans  le  cas  où  une  convention  sera  conclue

  des  Etats  belligérants,  et  recouvrées  apres
la  guerre,  cet  intérst  devra,  dans  le  cas  de  pertes
recouvrables  en  vertu  de  contrat  d’'assurance  maritime,
  courir  à  partir  de  I’expiration  d’'’une  période
d’un  an  à  compter  du  jour  de  ces  pertes.

In  any  case  where  by  the  law  applicable  to
the  contract  the  insurer  remains  bound  by  the
contract  notwithstanding  the  non-payment  of
Premiums  until  notice  is  given  to  the  insured  of
the  termination  of  the  contract,  he  shall  be  entitled
  where  the  giving  of  such  notice  was  prevented
  by  the  war  to  recover  the  unpaid  premiums
  with  interest  at  five  per  cent.  per  annum
from  the  insured.

Insurance  contracts  shall  be  considered  as  con-Marine

  Insurance.

16.

Contracts  of  marine  insurance  including  time
policies  and  voyage  policies  entered  into  between
an  insurer  and  a  person  who  subsequently  became
an  enemy,  shall  be  deemed  to  1  ave  been  dissolved
on  his  becoming  an  enemy,  except  in  cases  where
the  risk  undertaken  in  the  contract  had  attached
before  he  became  an  enemy.

Where  the  risk  had  not  attached,  money  paid
by  way  of  premium  or  otherwise  shall  be  recoverable
  from  the  insurer.

Where  the  risk  had  attached  effect  shall  be

iven  to  the  contract  notwithstanding  the  party

ecoming  an  enemy,  and  sums  due  under  the
contract  either  by  way  of  premiums  or  m  respect
of  losses  shall  be  recoverable  after  the  coming  into
force  of  the  present  Treaty.  »

In  the  event  of  any  agreement  being  come  to
for  the  payment  of  int  rest  on  sums  due  before
the  war  to  or  by  the  nationals  of  States  which
have  been  at  war  and  recovered  after  the  war,  such.
interest  shall  in  the  case  of  losses  recoverable
under  contracts  of  marine  insurance  run  from  the
expiration  of  a  period  of  one  Fear  from  the  date
of  the  loss.
