Article  305.

Si  un  tribunal  compétent  a  rendu  ou  rend  un
jugement  dans  une  affaire  visée  par  les  Sections
II,  IV,  V  ou  VII  et  si  ce  jugement  n'est  pas
conforme  aux  dispositions  desdites  Sections,  la
bertie  qui  aura  subi,  de  ce  chef,  un  préjudice  aura
roit  à  une  réparation  qui  sera  déterminée  par  le
Tribunal  arbitral  mixte.  Sur  la  demande  du  ressortissant
  d’une  Puissance  alliéce  ou  associée,  la
réparation  ci-dessus  visée  pourra  étre  effectute,
lorsque  cela  sera  possible,  par  le  Tribunal  arbitral
mixte  en  replaçant  les  parties  dans  la  situation
où  elles  se  trouvaient  avant  le  jugement  rendu
par  le  tribunal  allemand.

SECTION  VII.
PROPRIETE  INDUSTRIELLE.

Article  306.

Sous  réserve  des  stipulations  du  présent  Traité,
les  droits  de  propriété  industrielle,  littéraire  ou
artistique,  telle  que  cette  propriété  est  définie  par  les
Conventions  internationales  de  Paris  et  de  Berne
visées  à&amp;  F’article  286,  seront  rétablis  ou  restaurés,
à  partir  de  la  mise  en  vigueur  du  présent  Traité
dans  les  territoires  des  Hautes  Parties  Contractantes
en  faveur  des  personnes  qui  en  Staient  bénéficiaires,
au  moment  od  I’'état  de  guerre  acommencdé  d’exister,
ou  de  leurs  ayants  droit.  De  méme  les  droits  qui,
si  la  guerre  n’'avait  pas  eu  lieu,  auraient  pu  stre
acquis  pendant  la  durée  de  la  guerre,  à  la  suite
d’une  demande  formée  pour  la  protection  de  la
Propriété  industrielle  ou  de  la  publication  d’une
ceuvre  littéraire  ou  artistique,  seront  reconnus
et  établis  en  faveur  des  personnes  qui  y  auraient
des  titres,  à  partir  de  la  mise  en  vigueur  du  présent
Traité.

Toutefois,  les  actes  faits  en  vertu  des  mesures
spéciales  qui  auront  été  prises  pendant  la  guerre,
Par  une  autorité  Ilé6gislative,  exéecutive  ou  administrative
  d’une  Puissance  alliéce  ou  associée  à
légard  des  droits  des  ressortissants  allemands,
en  matière  de  propriété  industrielle,  littéraire  ou
artistigue  demeureront  valables  et  continueront  à
Avoir  leurs  pleins  effets.

In’yaura  lieu  à  aucune  revendication  ou  action
de  la  part  de  PAllemagne  ou  des  ressortissants
allemands  contre  Putilisation  qui  aurait  été  faite
Pendant  la  durée  de  la  guerre,  par  le  Gouvernement
  d'’une  Puissance  allice  ou  associée  ou  par
toute  personne,  pour  le  compte  de  ce  Gouvernement
  ou  avec  son  assentiment,  de  droits  de  propriété
  industrielle,  littérairo  ou  artistique,  ni
contre  la  vente,  la  mise  en  vente  ou  P’emploi  de
pProduits,  appareils,  articles  ou  objets  quelconques
auxquels  s'appliquaient  ces  droits.

Article  305.

Whenever  a  competent  court  has  given  or
gives  a  decision  in  a  case  covered  by  Sections  III,
IV,  Vor  VII,  and  such  decision  is  inconsistent  with
the  provisions  of  such  Sections,  the  party  who  is
prejudiced  by  the  decision  shall  be  entitled  to
obtain  redress  which  shall  be  fixed  by  the  Mixed
Arbitral  Tribunal.  At  the  request  of  the  national
of  am  Allied  or  Asscciated  Power,  the  redress  ma)y,
whenever  possible,  be  effected  by  the  Mixzed
Arbitral  Tribunal  directirg  the  rep’acement  of
the  parties  in  the  position  occupled  by  them
grfore  the  jugment  was  given  by  the  German

urt.

SECTILON  VII.
INDUSTRLAL  PROPERTT.

Article  306.

Subiect  to  the  stipulations  of  the  present  Treaty,
rights  of  industrial,  literary  and  artistic  property,  as
suchpropertyisdefined  by  the  International  Conventions
  of  Paris  and  of  Berne,  mentioned  in  Article
286,  shall  be  re-established  or  restored,  as  from  the
coming  into  force  of  the  present  Treaty,  in  the
territories  of  the  Higb  *  Parties,  in
favour  of  the  persons  entitled  to  the  benefit  of
them  at  the  moment  when  the  state  of  war  commenced
  or  their  legal  representatives.  Ednally,
rights  which,  except  for  the  war,  would  have  been
acquired  during  the  war  in  consequence  of  an  application
  made  for  the  protection  of  industrial
Property,  or  the  publication  of  a  literary  or  artistic
  work,  shall  be  recognised  and  established  im
favour  of  those  persons  who  would  have  been  entitled
  thereto,  from  the  coming  into  force  of  the
Present  Treatpy.

Nevertheless,  all  acts  done  by  virtue  of  the
special  measures  taken  during  the  war  under
legislative,  executive  or  administrative  authority.
#of  any  Allied  or  Associated  Power  in  regard  to
the  rights  of  German  nationals  in  industrial,

hterary  or  artistic  property  shall  remain  in  force

and  shall  continue  to  maintain  their  full  effect.

No  claim  shall  be  made  or  action  brought  by
Germany  or  German  nationals  in  respect  of  the
use  during  the  war  by  the  Government  of  any
Allied  or  Asscciated  Power,  or  by  any  persons
acting  on  behalf  or  with  the  assent  of  such  Government,
  of  any  rights  in  industrial,  literary  or
artistic  property,  nor  in  respect  of  the  sale,  offering
  for  sale,  or  use  of  any  products,  articles
or  apparatus  whatsoever  to  which  such  rights
applied.
