Cet  article  ne  sera  pas  applicable  aux  rapports
entre  les  Etats-Unis  d'Amérique,  d'une  part,  et
5FAllemagne  d’'autre  part.

Article  310.

Les  contrats  de  licences  d’exploitation  de
droits  de  propricte  industrielle  ou  de  reproduction.
d'œuvres  littsraires  ou  artistiques  Conclus  avant
la  déclaration  de  guerre  entre  des  ressortissants
des  Puissances  alliées  ou  asseciées  ou  des  personnes
  résidant  sur  leur  territoire  ou  y  exerçant
leur  industrie  d’une  part  et  des  ressortissants
allemands  d’autre  part,  seront  considéré  comme
résiliés,  à  dater  de  la  déclaration  de  guerre,  entre
I’Allemagne  et  la  Puissance  allice  ou  asscociée.
Mais,  dans  tous  les  cas,  le  bénéficiaire  primitif
d’un  contrat  de  ce  genre  aura  le  droit,  dans  un
délai  de  six  mois  à  dater  de  la  mise  en  vigueur  du
Présent  Traité,  d’exiger  du  titulaire  des  droits  la
concession  d’une  nouvelle  licence,  dont  les  conditions,
  à  défaut  d’entente  entre  les  parties,  seront
fixées  par  le  tribunal  düment  qualifié  à  cet  effet
dans  le  pays  sous  la  Igislation  duquel  les  droits
ont  &amp;4  acquis,  sauf  dans  le  cas  de  licences  obtenues
  en  vertu  de  droits  acquis  sous  la  IGgislation
allemande;  dans  ce  cas,  les  conditions  seraient
fixzées  par  le  Tribunal  arbitral  mixte  prévu  par  la
Section  VI  de  la  présente  Partie.  Tribunal
pourra,  s'il  y  a  lieu,  fixer  alors  le  montant  des
redevances  qui  lui  parattraient  justifiées,  en  raison
de  Putilisation  des  droits  pendant  la  durée  de  la
guerre.

Les  licences  relatives  à  des  droits  de  propriété
industrielle,  litteraire  ou  artistique  qui  auront  606
concédés  suivant  la  Igislation  spéciale  de  guerre
d’une  Puissance  alliée  ou  asscocièée  ne  pourront  se
trouver  atteintes  par  la  continuation  d  une  licence
existant  avant  la  guerre,  mais  elles  demeureront
valables  et  continueront  à  avoir  leurs  pleins  effets,
et  dans  le  cas  on  une  de  ces  licences  aurait  6té
accordée  au  bénéficiaire  primitif  d’'un  contrat  de
licenoe  passé  avant  la  guerre,  elle  sera  oonsidérée
comme  s'y  substituant.

Lorsque  des  sommes  auront  été  payées  pendant
  la  guerre,  en  vertu  de  contrat  ou  licence
qduelconques  intervenus  avant  la  guerre  pour
Texploitation  des  droits  de  propriété  industrielle
ou  pour  la  reproduction  ou  la  représentation
d’rCeuvres  littéraires,  dramatiques  ou  artistiques,
ces  sommes  recevront  la  méme  affectation  que  les
autres  dettes  ou  créances  des  ressortissants  allemands,
  conformément  au  présent  Traité.

Cet  article  ne  sera  pas  applicable  aux  rapports
entre  les  Etats-Unis  d’Amérique,  d’une  part,  et
IAllemagne,  d’autre  part.

the  possessor  of  the  rights  was  domiciled  or  had
an  industrial  or  Commercial  establishment  in  the
districts  oocupied  by  Germany  during  the  war.

This  Article  shall  not  apply  as  between  the
United  States  of  America  on  the  one  hand  and
Germany  on  the  other.

Article  310.

Licences  in  respect  of  industrial,  literary  or
artistic  kroperty  concluded  before  the  war  between
nationals  of  the  Allied  or  Associated  Powers  or

ersons  residing  in  their  territory  or  carrying  on
Eusiness  therein,  on  the  one  part,  and  German
nationals,  on  the  other  part,  shall  be  considered
as  cancelled  as  from  the  date  of  the  declaration
of  war  between  Germany  and  the  Allied  or  Associated
  Power.  But,  in  any  case,  the  former
beneficiary  of  a  contract  of  this  kind  shall  have
the  right,  within  a  period  of  six  monthbs  after  the
coming  into  force  of  the  present  Treaty,  to  demand
from  the  proprietor  of  the  rights  the  grant  of  a
new  licence,  the  conditions  of  which,  in  default
of  agreement  between  the  parties,  shall  be  fixed
by  the  duly  qualified  tribunal  in  the  country  under
whose  legislation  the  rights  had  been  acquired,
except  in  the  case  of  licences  held  in  respect  of
rights  acquired  under  German  law.  In  such  cases
the  Cconditions  shall  be  fixed  by  the  Mixed  Arbitral
Tribunal  referred  to  in  Section  VI  of  this  Part.
The  tribunal  may,  if  necessary,  fix  also  the  amount
which  it  may  deem  just  should  be  paid  by  reason
of  the  use  of  the  rights  during  the  war.

No  licence  in  respect  of  industrial,  literary  or
artistio  property,  granted  under  the  special  war
legislation  of  any  Allied  or  Asscciated  Power,  shall
be  affected  by  the  continued  existence  of  an
licence  entered  into  before  the  war,  but  sha
remain  valid  and  of  full  effect,  and  a  licence  so
granted  to  the  former  beneficiary  of  a  licence
entered  into  before  the  war  shall  be  considered
as  substituted  for  such  licence.

Where  sums  have  been  paid  during  the  war  by
Virtue  of  a  licence  or  agreement  concluded  before
the  war  in  respect  of  rights  of  industrial  propert)y
or  for  the  reproduction  or  the  representation  of
literary,  dramatic  or  artistic  works,  these  sums
shall  be  dealt  with  in  the  same  manner  as  other
debts  or  credits  of  German  nationals,  as  provided
by  the  present  Treaty.

This  article  shall  not  apply  as  between  tbe
United  States  of  America  on  the  one  hand  and
Germany  on  the-  "other.
