navigable,  chaque  Etat  riverain  sera  tenu  de
Prendre,  dans  la  mesure  convenable,  les  dispositions
  nécessaires  à  l’effet  d'’écarter  tous  obstacles
ou  dangers  pour  la  navigation  et  d’'assurer  le
maintien  de  la  navigation  dans  de  bonnes  conditions.


Si  un  Etat  néglige  de  se  conformer  à  cette  obligation,
  tout  Etat  riverain  ou  représenté  à  la  Commission
  internationale,  s'il  y  en  a  une,  pourra  en
appeler  à  la  juridiction  instituse,  à  cet  effet,  par
la  Société  des  Nations.

Article  337.

I.  sera  —*  de  la  meéme  maniere,  dans  le
cas  ou  un  Etat  riverain  entreprendrait  des  travauzx
de  nature  à  porter  atteinte  à  la  navigation  dans
la  partie  internationale.  La  juridiction  visée  à
Particle  précédent  pourra  prescrire  la  suspension
ou  la  suppression  de  ces  travaux,  en  tenant  compte,
dans  ses  décisions,  des  droits  relatifs  à  P’irrigation,
àla  force  hydraulique,  aux  pöcheries  et  aux  autres
intéröts  nationaux,  dui,  en  cas  d’accord  de  tous
les  Etats  riverains  ou  de  tous  les  Etats  représentés
à  la  Commission  internationale,  s'il  en  existe  une,
auront  la  priorité  sur  les  besoins  de  la  navigation.

Le  recours  à  la  juridiction  de  la  Société  des
Nations  ne  sera  pas  suspensif.

Article  338.

Le  régime  formulé  dans  les  articles  332  à  337
ci-dessus  sera  remplacé  par  celui  qui  sera  institué
dans  une  Convention  générale  à  établir  par  les
Puissances  allices  et  associces  et  approuvée  par
la  Société  des  Nations,  relativement  aux  voies
navigables  dont  ladite  Convention  reconnaitrait
le  caracteère  international.  Cette  Convention  pourra
##appliquer  notamment  à  tout  ou  partie  des
résen  ux  fluviaux  de  I’Elbe  (Labe),  de  I’Oder  (Odra),
du  Niemen  (Russstrom-Memel-Niemen),  et  du
Danube  ci-dessus  mentionnés,  ainsi  qu'aux  autres
4ments  desdits  réseaux  fluviaux  dui  pourraient
ötre  compris  dans  une  définition  générale.

L'Allemagne  s'’engage,  conformément  aux  dispositions
  de  Particle  379,  à  adhérer  à  ladite  Convention
  générale,  ainsi  qu'à  tous  projets  de  revision
des  accords  internationaux  et  reglements  en
vigueur,  établis  comme  il  est  dit  à  article  343
ci-apres.

Article  339.

L'’Allemagne  cédera  aux  Puissances  allices  et
associées  intéressées,  dans  le  déelai  maximum  de
trois  mois  aprèes  la  notification  qui  lui  en  sera
faite,  une  partie  des  remorqueurs  et  des  bateaux
qui  resteront  immatriculés  dans  les  ports  des
réseaux  fluviaux  visés  à  l'article  331,  après  les
Prélévements  à  opérer  à  titre  de  restitution  ou  de
réparation.  L’'Allemagne  cédera  de  méme  le
matérial  de  toute  nature  nécessaire  aux  Puissances
  allices  et  associées  intéressées  pour  Fautili-Sation
  de  ces  réseaux.

bound  to  take  suitable  measures  to  remove  any
obstacle  or  danger  to  navigation  and  to  ensure
the  maintenance  of  good  conditions  of  navigation.


If  a  State  neglects  to  comply  with  this  obligation
  any  riparian  State,  or  any  State  reprcsented
  on  the  International  Commission,  if  there  is
one,  may  appeal  to  the  tribunal  instituted  for
this  purpose  by  the  League  of  Nations.

Article  337.

The  same  procedure  shall  be  followed  in  the
case  of  a  riparian  State  undertaking  any  works
of  a  nature  to  impede  navigation  in  the  international
  section.  The  tribunal  mentioned  in  the
Preceding  Article  shall  be  entitled  to  enforce  the
suspension  or  suppression  of  such  works,  making
due  allowance  in  its  decisions  for  all  rights  in
connection  with  irrigation,  water-power,  fisheries,
and  other  national  interests,  which,  with  the  consent
  of  all  the  riparian  States  or  of  all  the  States
represented  on  the  International  Commission,  if
there  is  one,  shall  be  given  priority  over  the
requirements  of  navigation.

Appeal  to  the  tribunal  of  the  League  of  Nations
  does  not  require  the  suspension  of  the

works.
Article  338.

The  régime  set  out  in  Articles  332  to  337  above
Shall  be  superseded  by  one  to  be  laid  down  in
a  General  Convention  drawn  up  by  the  Allied
and  Asscciated  Powers,  and  approved  by  the
League  of  Nations,  relating  to  the  waterways  recognized
  in  such  Convention  as  having  an  international
  character.  This  Convention  sball
apply  in  particular  to  the  whole  or  part  of  the
above-mentioned  river  systems  of  the  Elbe  (Labe),
the  Oder  (Odra),  the  Nemen  (Russstrom-Memel-Niemen),
  and  the  Danube,  and  such  other  parts
of  these  river  systems  as  may  be  covered  by  a
general  definition.

Germany  undertakes,  in  accordance  with  the
provisions  of  Article  379,  to  adhere  to  the  said.
General  Convention  as  well  as  to  all  projects
Prepared  in  accordance  with  Article  343  below
for  the  revision  of  existing  international  agreements
  and  regulations.

Article  339.

Germany  shall  cede  to  the  Allied  and  Associated
  Powers  concerned,  within  a  maximum
period  of  three  months  from  the  date  on  which
notification  shall  be  given  her,  a  Proportion  of
the  tugs  and  vessels  remaining  registered  in  the
ports  of  the  river  systems  refe  to  in  Article
331  after  the  deduction  of  those  surrendered  by
Way  of  restitution  or  reparation.  Germany  shall
in  the  same  way  cede  material  of  all  kinds  necessary
  to  the  Allied  and  Associated  Powers  concerned
  for  the  utilisation  of  those  river  systems.
