Article  360.

La  France  se  réserve  la  faculté  de  se  substituer
aux  droits  et  obligations  résultant  des  accords
intervenus  entre  le  Gouvernement  de  I’Alsace-Lorraine
  et  le  Grand-Duché  de  Bade  pour  les
travaux  à  exécuter  sur  le  Rhin;  elle  pourra  aussi
dénoncer  ces  accords  dans  un  ddlai  de  cinq  ans
à  dater  de  la  mise  en  vigueur  du  présent  Traité.

La  France  aura  6galement  la  faculté  de  faire
exécuter  les  travaux,  qui  seraient  reconnus  nécessaires
  par  la  Commission  centrale,  pour  le
maintien  ou  l’amélioration  de  la  navigabilité  du
Rhbin,  en  amont  de  Mannheim.  «

Article  361.

Au  oas  oü,  dans  un  délai  de  vingt-dind  années
à  dater  de  la  mise  en  vigueur  du  présent  Traité,
la  Belgique  déciderait  de  Créer  une  voie  navigable
à  grande  section  Rhin-Meuse,  à  la  hauteur  de
Ruhrort,  I’Allemagne  serait  tenue  de  construire,
d’après  les  plans  qui  lui  seraient  communiqués
par  le  Gouvernement  belge  et  apres  approbation
Par  la  Commission  centrale,  la  portion  de  cette
voie  navigable  situce  sur  son  territoire.

Le  Gouvernement  belge  aura,  en  pareil  cas,  le
droit  de  procéder  sur  le  terrain  à  toutes  les  études
nécessaires.

Faute  par  I’Allemagne  d’exécuter  tout  ou  partie
des  travaux,  la  Commission  centrale  aura  qdualité
pour  les  faire  exécuter  en  ses  lieu  et  place;  à  cet
effet,  elle  pourra  déterminer  et  délimiter  les  emlacements

  nécessaires,  et  occuper  les  terrains,  à
bes  iration  d’un  délai  de  deux  mois  apres  simple
notification,  moyennant  les  indemnités  qu'olle
fixera,  et  qui  seront  payées  par  I’Allemagne.

Cette  voie  navigable  sera  placée  sous  le  meme
régime  administratif  que  le  Rhin  lui-méme,  et  la
répartition  entre  les  Etats  traversés  des  frais  de
premier  établissement,  y  compris  les  indemnités
ci-dessus,  sera  faite  par  les  scins  de  la  Commission
  centrale.

Article  362.

L’Allemagne  s'engage  dées  à  présent  à  ne  faire
aucune  objection  à  toutes  propositions  de  la  Commission
  centrale  du  Rhin  tendant  à  étendre  sa
juridiction:

1°  à  la  Moselle,  depuis  la  frontiere  francoluxembourgoise
  jusqu'au  Rhin,  sous  réserve  de
l'assentiment  du  Luxembourg;

2°  au  Rhin,  en  amont  de  Bäle  jusqu’au  lac  de
Constance  sous  réserve  de  I’assentiment  de  la
Suisse;

3“  aux  canaux  latéraux  et  chenaux  qui  seraient
éGtablis,  soit  pour  doubler  ou  améliorer  des  sections
naturellement  navigables  du  Rhin  ou  de  la  Moselle,
soit  pour  réunir  deux  sections  naturellement  navigables
  de  ces  cours  d'eau,  ainsi  qu'à  tous  autres  Gléments
  du  réseau  fluvial  rhénan,  qui  pourraient  Ötre

Article  360.

France  reserves  the  option  of  substituting
herself  as  regards  the  rights  and  obligations  resulting
  from  agreements  arrived  at  between  the
Government  of  Alsace-Lorraine  and  the  Grand
Duchy  of  Baden  concerning  the  works  to  be  carried
  out  on  the  BRhine:  she  may  also  denounce
such  agreements  within  a  term  of  five  Fears  dating
  from  the  coming  into  force  ofthe  present  Treaty.

France  shall  also  have  the  option  of  causing
works  to  be  carried  out  which  may  be  recognised
as  necessary  by  the  Central  Commission  for  the
upkeep  or  improvement  of  the  navigability  of  the
Rhine  above  Mannheim.

Article  361.

Should  Belgium,  within  a  period  of  25  years
from  the  coming  into  force  of  the  present  Treaty
decide  to  create  a  deep-draught  Rhine-Meuse
navigable  waterway,  in  the  region  of  Ruhrort,
Germany  shall  be  bound  to  construct,  in  accordance
  with  plans  to  be  communicated  to  her  b
the  Belgian  Government,  after  agreement  witk
the  Central  Commission,  the  portion  of  this  navigable
  waterway  situated  within  her  territory.

The  Belgian  Government  shall,  for  this  purpose,
  have  the  right  to  carry  out  on  the  ground
all  necessary  surveys.

Should  Germany  fail  to  carry  out  all  or  part
of  these  works,  the  Central  Commission  shall  be
entitled  to  carry  them  out  instead;  and,  for  this
urpose,  the  Commissiom  may  decide  upon  and
X  the  limits  of  the  necessary  sites  and  occupy
the  ground  after  a  period  of  two  months  after
simple  notification,  subject  to  the  payment  of
indemnities  to  be  fixed  by  it  and  paid  by  Germany.


This  navigable  waterway  shall  be  placed  under
the  same  administrative  régime  as  the  Rhine
itself,  and  the  division  of  the  cost  initial  Construction,
  including  the  above  indemnities,  among
the  States  Crossed  thereby  shall  be  made  by  the
Central  Commission.

Article  362.

Germany  hereby  agrees  to  offer  no  objection
to  any  proposals  of  the  Central  Rhine  Commission
  for  extending  its  jurisdiotion:

(1)  to  the  Moselle  below  the  Franco-Luxemburg
  frontier  down  to  the  Rhine,  subject  to  the
consent  of  Luxemburg;

(2)  to  the  Rhine  *½i  Basle  up  to  the  Lake
8  Gonstance,  subject  to  the  consent  of  Switzerand:


(3)  to  the  lateral  canals  and  channels  which
may  be  established  either  to  duplicate  or  to  improve
  naturally  navigable  sections  of  the  Rhine
or  the  Moselle,  or  to  connect  two  naturally  navigable
  sections  of  these  rivers,  and  also  any
other  parts  of  the  Rhine  river  system  which  ma)y
