been the duty of the German Consul to take Part in the issuing of said proclamation, and it has not been proved that with regard to said decision any steps were taken by him contrary to the General Act, and therefore no responsi- bility attaches for the attitude taken up by him in this respect; Whereas — with respect to the contention of the British and United States’' Governments that, whether or not there was authority to insist by force on the acceptance of the provi- sions of the Berlin General Act, the military action was not unwarranted, because it was necessary for the protection of lives and property which it was the duty of the British and Ame- rican officers to safeguard, and because the opening of fire on the 15:th of March was necessitated by the Mataafan warriors making a rush on the British and the United States“ Consulates and by a threatened attack by several war canoes on Mulinuu, where a detachment from the British and American ships was statio- ned, — We have found nothing in the evidence before Us to show that the general condition of affaire was such as to render the militarz). action necessary for the protection of lives and property. and, as to the said two attacks alleged to have taken place on the 15:th of March, it results from all the facts relative thereto that the rush was not, and never was meant to be, san attack on the Consulates but simply was directed against some fleeing women of the Malietoa party, that no attack was intended on Mulinuu by the cancoes, which by the garrison there were seen putting out from the opposite shore of the Vaiusu bay and which were ordered by Mataafa to go along the coast to the west and, in fact, were going in that direction and not towards Mulinuu when the flring began, and that, on account of the state of the tide, it was not even possible at the time to pass the bay in candes; And whereas it is established not only that, on the arrival of the „Pbiladelphia“ on the 6:th of March, the Malietoans were completely defea- ted, and deported to distant places, and deprived of their arms, and unable to offer any resistance whatever to the victorious Mataafans, but also that in the last days before the beginning of 579 darstelle — nicht anerkannt werden kann, daß es Pflicht des deutschen Konsuls gewesen wäre, sich an dem Erlaß der erwähnten Proklamation zu betheiligen und in Erwägung, daß nicht erwiesen ist, daß von ihm mit Bezug auf die erwähnte Entscheidung irgendwelche mit der Generalakte in Widerspruch stehende Schritte gethan worden sind, und daß ihm deshalb aous dem von ihm be- obachteten Verhalten eine Verantwortlichkeit nicht zur Last fällt; in Erwägung, daß Wir — betreffs der von den Regierungen von Großbritannien und den Ver- einigten Staaten aufgestellten Behauptung, daß, abgesehen davon, ob eine Berechtigung vorlag, auf die zwangsweise Durchführung der Vorschriften der Berliner Generalakte zu dringen oder nicht, die mililärische Aktion nicht ungerechtfertigt ge- wesen wäre, weil sie nothwendig gewesen wäre zum Schutz von Leben und Eigenthum, welchen zu gewähren Pflicht der englischen und amerikanischen Offiziere war, und weil ihnen die Eröffnung des Feuers am 15. März ausgezwungen sei durch einen Ueberfall der Mataasa-Krieger auf die Konsulate von Großbritannien und den Vereinigten Staaten und durch einen drohenden Angriff ver- schiedener Kriegskanus auf Mulinun, dem Stand- ort eines Detachements von den englischen und amerikanischen Schiffen — in dem Uns vor- liegenden Beweismaterial keinen Anhalt dafür gesunden haben, daß die allgemeine Lage der Dinge eine solche gewesen wäre, um die militärische Aktion als für den Schutz von Leben und Eigen- thum nothwendig erscheinen zu lassen, und in Erwägung, daß sich hinsichtlich der beiden An- griffe, die angeblich am 15. März stattgefunden haben, aus allen hierauf bezüglichen Thatsachen ergiebt. daß der Ueberfall weder nach dem that- sächlichen Verlauf noch nach der ihm unterliegenden Absicht einen Angriff auf die Konsulate darstellte, vielmehr lediglich gegen einige fliehende Weiber der Malietoa-Partei gerichtet war, und daß kein Angriff auf Mulinuu von den Kanus geplant war, welche von der dortigen Garnison von dem gegenüberliegenden Strande von Vaiusu abstoßend gesehen wurden und welche von Mataafa den Besehl erhalten hatten, längs der Küste nach Westen zu zu fahren und thatsächlich in dieser Richtung und nicht in der auf Mulinun bei Er- öffnung des Feuers in Fahrt waren, und daß mit Rücksicht auf den Wasserstand zu dieser Zeit es überhaupt nicht möglich war, die Bucht mit Kanus zu passiren; in Erwägung, daß festgestellt ist nicht nur, daß bei Ankunft der „Philadelphia" am 6. März die Malietoa-Anhänger vollständig besiegt, nach ent- fernten Plätzen verbracht, ihrer Waffen beraubt und nicht in der Lage waren, den siegreichen Mataafa-Anhängern irgend welchen Widerstand entgegenzusetzen, sondern auch, daß Mataafa in
