Aufenthalt nothwendig ist, um eine Per-
son, als unter den Vertrag fallend, an-
sehen zu können, wobei übrigens keines-
wegs erforderlich sein soll, daß der fünf-
jährige Aufenthalt erst nach der Naturali=
sation erfolgen müßte.
Doch wird hiebei anerkannt, daß in dem
Falle, wenn in dem einen Staate Ange-
hörige des andern Staats schon vorher in
rechtsgiltiger Weise naturalisirt werden,
ehe sie sich fünf Jahre daselbst aufgehalten
haben, die so naturalisirten Personen von
dem Momente ihrer Naturalisation an in
dem Staate, wo solche erfolgt ist, nicht
nur alle staatsbürgerlichen Rechte auszu-
üben, sondern auch an allen staatsbürger-
lichen Pflichten Theil zu nehmen haben.
2) Die Worte: „ununterbrochen zuge-
bracht“ sind selbstverständlich nicht im
körperlichen, sondern im juristischen Sinne
zu nehmen, und deshalb unterbricht eine
momentane Abwesenheit, eine Reise oder
dergleichen keineswegs die fünfjährige Frist,
welche der Art. 1 im Sinne hat.
II. Zu Artikel 2 des Vertrags:
Württembergischer Seits wird aner-
kannnt, daß hiernach allen in Gemäßheit
des Artikels 1 des Vertrags als ameri-
kanische Staatsbürger anzuerkennenden
früheren Württembergern, welche vor oder

by no means requisite, that the five years
residence should take place alter the
naturalization.
Tet it is bereby agreed, that, if
citizens of the one state become legall
naturalized in the other state before they
have resided there five years, the per-
sons So naturalized from the moment of
their naturalization, have to egercise all
eivil rights and are liable to all civil
duties in the state into whbich they have
been adopted.
2) The words „resided uninterruptedl)“
are obviousl) to be understood, not of

legal sense; and therefore a transient
absence, a journe) or the like by no
means interrupts the period of fve years
contemplated by the first article.
